Fernández is accused of
violating article 205 of the Penal Code,
which provides a penalty of 6 months to two years in prison for anyone who "violates the measures adopted by the competent authorities to prevent the introduction or spread of an epidemic."
The unusual thing about the situation is that the "competent authority" that "adopted" the "measures"
is Fernández himself,
who governs with a series of extraordinary powers delegated by Parliament and signed a good number
of Necessity and Urgency Decrees (DNU )
amid the covid-19 pandemic.
It is Fernández who ignores Fernández himself.
After blaming his partner,
Fabiola Yäñez,
for organizing the party, Fernández came to the conclusion that it was "a mistake", and promised that "it will not be repeated."

University of Buenos Aires (UBA),
in which he is a professor, wielded a striking defense of his own case:

Fernández's theory was received with

by almost the entire range of legal experts, who point out that what the DNU signed by the president prohibited were social gatherings during the pandemic, without the need for these to lead to infections or not.
In a spontaneous presentation that was known today, the Argentine president offered to donate to
the Malbrán Institute,
specialized in virology, half of his salary for the next four months:
630,000 pesos, just over 3,000 euros
in total.

Almost at the same time that the president's proposal was known, the lawyer for Vice President
Cristina Kirchner,
