Spencer Eldon, who was 4 months old at the time (in 1991), filed a lawsuit against the legacy of Kurt Cobain and the surviving members of the band, claiming that they violated federal child pornography laws and sexually exploited him.




According to NPR in 2008, the child's family was paid only $ 200 for the 15-second dip in the pool, which occurred because Elden's father was a friend of the photographer.



In the lawsuit, the boy claims to have suffered "lifelong damage," and claims that neither he nor his guardians have consented to the nude photo shoot. The band, the photographer and the record labels "intentionally commercialized Spencer's child pornography", the documents read, in which it is explained that Elden was forced to perform "commercial sexual acts" and the band took back a alleged promise to hide his genitals on the album cover.



In 2016, however, the 25-year-old Elden had recreated the fully dressed cover image to pay homage to the record: according to the media he seemed enthusiastic about the initiative, even if he asked that the band remain away. In the lawsuit, Spencer then seeks damages and an injunction preventing the group from profiting from the album.
