The legal services of the Madrid City Council
have dismissed the appeal
presented by Rita Maestre and thus endorse that the four split-off councilors of Más Madrid (Marta Higueras, José Manuel Calvo, Luis Cueto and Felipe Llamas) go to the Mixed Group in the Madrid City Council, According to 'ABC' and sources from Recupera Madrid have confirmed to Europa Press.
In this way, the administrative appeal presented by the current leader of Más Madrid on April 8
against the constitution three days before the Mixed Group
has been dismissed
, according to a resolution of the Presidency of the Plenary of the City Council dated this Monday.
Recupera Madrid
raised in March a consultation with the City Council
about its situation.
The Administration replied with a report from the Chairman of the Plenary, Borja Fanjul (PP), based on the one prepared by the secretary of the body, initiating the constitution of the Mixed Group.
More Madrid appealed this decision, the same as Vox, so that the constitution of the Mixed was suspended until the City Council analyzed the resources.
The one from Vox was rejected on the grounds that
it was not a matter of their competence
, they transferred from Recupera Madrid, and the resource of Más Madrid received negative administrative silence.
Now, the legal services of the City Council have dismissed the appeal of Más Madrid "in attention to the legal basis contained in the report issued by the General Secretariat of the Plenary of the City Council, dated May 7, 2021" and
lifts the suspension of training of the Mixed Group
agreed on April 13.
In this way, and according to article 31 of the Organic Regulation, the Plenary of the Madrid City Council, this Group will have rights similar to those of the rest and the Municipal Technical Services will
proceed to make the economic
, personal, technical and material
adjustments
that respond to the new situation.
However, a contentious-administrative appeal may be filed before the competent court against this resolution
within a period of two months.
