An (Arab) employee in one of the institutions was surprised by her (African) co-worker who hugged her from behind, against her will, and put his hands on her arms and his head on her shoulder, justifying this by joking with her, which prompted her to inform the Dubai Police, who arrested him and referred him to the Public Prosecution and from there to The Criminal Court sentenced him to three months in prison and deported him from the state, after he was convicted of indecent assault.

The employee (the victim) stated in the investigations of the Dubai Public Prosecution, that she was at the head of her work and noticed that her 40-year-old colleague was behaving in a strange way, then he came from behind and joined her to him.

In his testimony to the investigations, the security guard confirmed the truthfulness of the victim's story, pointing out that she was turning her back on him when the employee committed this behavior.

For his part, the accused employee in the Public Prosecution investigations admitted that he put his hands on the victim's shoulder jokingly with her without her consent, then retracted his statements before the court and denied his act, demanding that the surveillance cameras be unloaded.

Referring to the competent authorities, it was found that there are no recordings, as they are automatically deleted from the cameras’ memory after 31 days, and the court has settled in the conviction of the accused, noting that despite the accused’s later denial, it has the absolute authority to take his confession in any of the investigation stages.

The court confirmed that it was satisfied with the evidence in the case, as well as the testimony of the witness, which coincided with the statements of the victim, and the confession of the accused himself before the Public Prosecution.

Accordingly, the court’s belief was that the 40-year-old accused indecently assaulted the victim, but decided, given the circumstances of the case, to take him with a measure of clemency and inflicted the penalty on three months’ imprisonment and deported him after serving his sentence.
