An unemployed man kidnaps his cousin "because he's afraid for her"

And as soon as the residents of the house saw him, they shouted at him to get out, but he threatened them with slaughter if they obstructed his way, and then went to her room, which she closed on herself after she heard her husband’s family screaming, so he broke into the room after breaking the door lock, and threatened her with a knife until she confesses the slander, and she denied him what he said , confirming that his suspicion was incorrect, so he searched the room, then pulled her forcefully from her hand, causing abrasions to her knee, and forced her to board the vehicle and kidnapped her until he forced her to tell the truth. He informed her husband's family about the incident.

After his arrest, the accused confessed in the police report and investigations of the Public Prosecution to the incident, noting that the victim was his cousin, and he was told that she was meeting strange men, so he decided to go to her husband's father's house where she resides, and he entered it without the will of his companions, and took her by force.

The accused attributed his behavior to the fact that he wanted to talk to her at his convenience, and committed the crime because he was afraid for her, and that he could not return her to her father-in-law's house because the incident occurred during the period of national sterilization and movement restrictions.

The victim stated in the investigations of the Public Prosecution that the accused was in an abnormal condition, when he broke into her room carrying a medium-sized knife, pointing out that she could not escape from his car because the doors were tightly closed, and the testimony of the victim matched the testimony of her husband's sisters and the rest of the residents of the house who were present At the time of the incident, one of them said that she was accompanied by her father and mother when the accused pushed the door of the house forcefully and entered the hall, shouting, “Where is she?” He holds a knife in his hand for cutting vegetables. Then he went straight to the victim's room and kidnapped her.

The case papers stated that the accused retracted his statements during the trial and denied the accusation against it, and the memorandum he submitted included an objective defense aimed at questioning the evidence, but the court confirmed its confidence in the evidence, and its conviction that his denial is just a means of evading punishment, and in return it is It did not adhere to the legal description by the Public Prosecution of the charges against the accused, and combined them all into the kidnapping charge, and ruled to convict him, but decided, according to the circumstances of the crime, to treat him with a measure of clemency and imposed the penalty to the extent permitted by Article 89 of the amended Federal Penal Code, which is one year imprisonment.

Regarding the accusation of consuming alcoholic beverages, which the Public Prosecution also directed against the accused, the Criminal Court concluded that it did not have jurisdiction to consider this accusation and referred her to the Misdemeanors Court, as it has jurisdiction.
