August 10, 2021Owners of bars and restaurants can ask customers to show documents in addition to the Green Pass. This is what the Privacy Guarantor affirms in response to a question from the Piedmont region.



"The figures authorized to verify personal identity are those indicated in article 13 of the Prime Ministerial Decree of 17 June 2021 with the methods indicated therein, unless further changes may occur", specifies the Privacy Guarantor, answering a question addressed to the '' Authority from Piedmont on the verification and identification activities by the operators of restaurants and bars. 



Among the subjects listed by the Dpcm there are also "the owners of accommodation facilities and public establishments" who can therefore ask the holders of the green certification to show an identity document.



"The Guarantor for the protection of personal data - the note reads - met in an extraordinary session to examine the issue of data protection connected to the recent provisions on green passes and green certifications regarding the performance of school activities and to respond to a question addressed to the Authority by the Piedmont Region on the activity of verification and identification by the operators of restaurants and bars ". 



In the note sent to the Region, the Authority underlines that the "procedural discipline (now attributable to the Prime Ministerial Decree of 17 June 2021) includes - in addition to the regulation of the specific digital channels functional to the reading of the green certification - also the obligations to verify the identity of the owner of the same, in the manner and under the conditions set forth in art. 13, paragraph 4, of the aforementioned Prime Ministerial Decree ". This article specifies that "the holder of the green certification at the time of verification proves, at the request of the verifiers, his personal identity by showing an identity document".



The Guarantor therefore specifies that "the processing of personal data is permitted consisting in the verification, by the subjects referred to in art. 13, c.2, of the identity of the holder of the green certification, by requesting an identity document ".



Among the subjects listed in the aforementioned article there are: public officials in the exercise of their functions; the staff assigned to control services for entertainment and show activities; the owners of accommodation facilities and public businesses; the owner or legitimate holder of places or premises where events and activities take place; air, sea and land carriers; the managers of the structures that provide health services. 



The guarantees provided by this decree - the Guarantor reminds us - "also include the exclusion of the collection, by the verifiers, of the data of the holder of the certification, in any form".
