Chinanews.com, August 10th. According to the website of the Ministry of Culture and Tourism, in order to strengthen the management of karaoke music content in song and dance entertainment venues, promote the core socialist values, and promote the high-quality development of the song and dance entertainment industry, the Ministry of Culture and Tourism has formulated the "Song and Dance Entertainment" The Interim Provisions on the Management of Karaoke Music Content in Venues (hereinafter referred to as the "Regulations") will come into force on October 1, 2021.

It is clearly stated in the interim regulations to establish a national karaoke music repertoire list system.

  The "Regulations" clarify that the Ministry of Culture and Tourism is responsible for establishing a national karaoke music content review expert group and establishing a national karaoke music repertoire list system.

  The "Regulations" require that karaoke music played in singing and dancing entertainment venues must not contain the contents prohibited by Article 13 of the "Regulations on the Administration of Entertainment Places": (1) Violation of the basic principles established by the Constitution;

  (2) Endangering national unity, sovereignty or territorial integrity;

  (3) Endangering national security, or harming national honor and interests;

  (4) Inciting ethnic hatred, ethnic discrimination, hurting ethnic feelings or infringing ethnic customs and habits, and undermining ethnic unity;

  (5) Violating the state's religious policies and promoting cults or superstition;

  (6) Propagating obscenity, gambling, violence and drug-related illegal and criminal activities, or instigating crime;

  (7) Violating social ethics or national excellent cultural traditions;

  (8) Insulting or slandering others, infringing on the lawful rights and interests of others;

  (9) Other content prohibited by laws and administrative regulations.

  The “Regulations” clearly stated that the National Culture and Entertainment Industry Association should guide the industry to strengthen content self-discipline, remind song-on-demand system content providers and song and dance entertainment venues to delete music products containing content prohibited by laws and regulations in a timely manner, and assist industry authorities in handling them in accordance with laws and regulations.

  The "Regulations" emphasize that if the cultural and tourism administrative departments find that the karaoke music provided by the song-on-demand system content provider to the song and dance entertainment venues contains content prohibited by laws and regulations, they can warn and stop them through administrative guidance methods such as interviews; Where a venue provides karaoke music that has been included in the national karaoke list of illegal tracks, it may announce the name of the song-on-demand system content provider, the illegal tracks and other information to the public for notification.

  At the same time, the Market Management Department of the Ministry of Culture and Tourism interpreted the "Regulations":

  1. What is the main background of the "Notice of the Ministry of Culture and Tourism on Printing and Distributing the "Interim Regulations on the Management of Karaoke Music Content in Singing, Dance and Entertainment Places""?

  The "Regulations on the Administration of Entertainment Places" stipulate that the tracks and screen images played in singing and dancing entertainment venues must not contain content prohibited by Article 13 of the regulations.

However, the phenomenon that the song-on-demand system of song and dance entertainment venues contains prohibited songs has been repeatedly prohibited.

The reason is that the basic music library of the song-on-demand system of song and dance entertainment venues is more than 100,000, and it is difficult for the operators of song and dance entertainment venues to identify illegal tracks; second, there are nearly 50,000 song and dance entertainment venues nationwide, which are difficult to enforce and supervise.

The source of karaoke music in singing and dancing entertainment venues is the content provider of the song-on-demand system. The content provider of the song-on-demand system conducts self-examination on the content of karaoke music, which can effectively control the content of singing and dancing entertainment venues from the source.

  2. How do content providers of song-on-demand systems and song and dance entertainment venues carry out content self-examination?

  The "Notice" supports the content providers of the song-on-demand system to establish a self-review mechanism for karaoke music content, reasonably appoint professionals, and conduct self-checking of karaoke music tracks, screens and other content in the production, dissemination, and reproduction of karaoke music. Review to ensure that the source and content of karaoke music are legal.

Singing and dancing entertainment venues shall use karaoke music with legal sources and self-examination of content, and shall not use karaoke music with content prohibited by laws and regulations.

The Ministry of Culture and Tourism will also instruct the China Culture and Entertainment Industry Association to strengthen training for content providers of song-on-demand systems and singing and dancing entertainment venues, and provide expert consulting services for its content self-examination.

If it is difficult to determine the content provider of the song-on-demand system and the singing and dancing entertainment venues during the self-examination process, they can also be submitted to the China Culture and Entertainment Industry Association for guidance.

  3. How to create a list of illegal tracks for karaoke music across the country?

  The list of illegal tracks for karaoke music across the country is generated by two means: one is that the local cultural and tourism administrative department reports the illegal tracks to the Ministry of Culture and Tourism, and the other is that the song on-demand system content provider found suspected illegal tracks during the self-examination process and passed the whole country. The sex industry association reports to the Ministry of Culture and Tourism. The Ministry of Culture and Tourism is responsible for identifying and including the illegal tracks in the national karaoke music list.

The content provider of the song-on-demand system shall not provide, and the music and dance entertainment venues shall not use the music products in the list of illegal tracks.

  4. How to manage the karaoke music content of Mini Singing Pavilion?

  The "Notice" requires that the content of the karaoke music in the mini singing booth should refer to the content management of singing and dancing entertainment venues. The reasons are as follows: First, the karaoke music in the mini singing booth and the karaoke music in the on-demand system of singing and dancing entertainment venues contain the same content management problems, and the content provider of the song-on-demand system also provides karaoke music; the second is the 2017 "Culture Ministry’s Notice on Guiding the Healthy Development of the Mini Singing Pavilion Market "Incorporating the new format of Mini Singing Pavilion into supervision, clarifying the requirements for the bottom-line management of Mini Singing Pavilion content and platform content self-examination; third, referring to the content management of singing and dancing entertainment venues, adopting a source content self-examination mechanism +Illegal track list system, which can effectively control the content of karaoke music in the mini singing booth.
