As SVT previously reported, the case was recently tried by the Land and Environmental Court in Växjö.
Then the couple won - but the municipality appealed.
The judgment from the Land and Environmental Court stated: "Lack of routines on the part of the municipality cannot be blamed on the defendant approximately 40 years after the facility was expanded"
Until now, the case has been with Mittskåne water.
Now the municipality is giving up
But now the municipality has chosen to withdraw the appeal.
Lars-Göran Ritmer, chairman of the water and rescue committee in Hörby, has in an earlier comment to SVT given the couple their support.
- I think you should withdraw the appeal, it is a forty year old case and you have not tried to collect money before, so I think it is a scandal that you try to collect it in this way, says Lars-Göran Ritmer (M) .
It feels great!
When SVT called the spouses, they had not yet been reached by the news that the appeal had been withdrawn.
- I was very taken by it, so I do not really know what to comment on.
But it feels great!
It was good, now we can only be happy, says Börje Lundström.
