The extension of the health pass and the compulsory vaccination of caregivers, two flagship measures of the health bill, were validated on Thursday, August 5, by the Constitutional Council.

On the other hand, the Wise Men censored the compulsory isolation of people who tested positive for Covid-19.

The Constitutional Council has thus validated the use of the health pass in cafes, bars and restaurants but also in the hospital, provided that the latter "is not an" obstacle to access to care. "The health pass will be also set up in certain shopping centers "beyond a certain threshold defined by decree" and if "the seriousness of the risk of contamination" at the level of a department justifies it, decided the Wise Men.

Mandatory isolation of people tested positive censored

Constitutional judges, however, censored the plan to make isolation compulsory for people who test positive for Covid-19.

Isolating patients for 10 days is neither "necessary", "nor appropriate and proportionate" and this measure constitutes a measure depriving the person of liberty "without an individual decision based on an assessment of the administrative or judicial authority", they pleaded.
