A Brazilian judge acquitted the young
Marvin Henriques Correia,
alleged accomplice in the murder of the four members of a Brazilian family in the Spanish town of
Pioz,
committed by his then friend
Patrick Nogueira
in August 2016, official sources reported this Thursday.

Aylzia Fabiana Borges Carrilho,
from the state of Paraíba (northeast), considered in her sentence, for which there is an appeal, that the defendant
did not practice any crime typified in the Brazilian Penal Code,
before which she issued his summary acquittal.
Henriques Correia was arrested by the Brazilian Police for the heinous crime that shocked Spain and Brazil, on suspicion of
having collaborated with the perpetrator of the quadruple murder,
although he was later released with precautionary measures.
According to the proceedings, Nogueira killed his aunt and his young cousins and immediately began to speak with Henriques Correia through WhatsApp.
In the conversation, he explained all the details of the three murders committed and stated that he was waiting for the arrival of his uncle to also take his life.
In the process, it also appears that Nogueira, given the long wait, showed signs of exhaustion and hinted that he would not kill his uncle, before which
Henriques Correia instigated him to persist in his original idea of murdering the entire family,
which finally occurred.
In this context, the magistrate pointed out that, despite Henriques Correia's conduct being
"abject, disgusting, sordid, cold and vile",
it cannot be considered "criminal" because "it simply" has not been "described in criminal law. as such".
"Considering that to characterize the existence of a criminal offense it is necessary that the conduct be classified and illegal, there is no doubt that the facts narrated in the complaint, with regard to the accused Marvin,
do not constitute a criminal offense," he
explained.
"At most, they could be considered as preparatory acts; however, in our legal system subjective conduct is not classified," he stressed.
In his opinion, in this case
there is a "legal vacuum"
that cannot be filled by the Judiciary, whose function is "to do justice, but not at any cost."
"The discretionary power of a magistrate to judge is within the limits of our legal system," he completed.
The crime occurred in August 2016, but it was only known a month later when the Spanish authorities
found the dismembered bodies of the family in a chalet
where they lived, located in the town of Pioz, in the province of Guadalajara.
In October of that year Patrick Nogueira was arrested in Madrid, where he arrived from Brazil, after voluntarily surrendering himself, and shortly afterwards a judge ordered his admission to prison after confessing the crime.
Two years later, in 2018, he was
sentenced by a popular Spanish jury to reviewable permanent prison.
