CAIRO -

The Egyptian parliament's approval, in principle, of a bill allowing the dismissal of employees belonging to the Muslim Brotherhood, which is classified by the Egyptian regime as "terrorist", sparked controversy on social media, between supporters and opponents.

The Egyptian House of Representatives discussed, during its plenary session, yesterday, Monday, a bill submitted by 10 parliamentarians to amend some provisions of the law on dismissal by other than the disciplinary method, which aims to dismiss employees affiliated with the Brotherhood or those whom the project described as “terrorist elements” from the state’s administrative apparatus.

The required amendments received the initial approval of most of the parliamentarians, who considered that it does not contradict the articles of the constitution, and works to “protect national security”, while representatives of the Egyptian Social Democratic Party rejected it, considering it a “flaw” that could be exploited in settling accounts.

According to local media, the party’s deputy, Maha Abdel Nasser, confirmed that the separation in this way “does not have any guarantees,” warning that the law, after its approval, would turn into “a sword and a tool for revenge in the hands of the chiefs against their subordinates, and into a tool against any opponent.” Or rejecting the actions of heads in government institutions.

Although the approval is preliminary, and the entry into force of these amendments still requires other measures, this has called for quarrels and controversy on the communication sites, where some celebrated it as a necessary step to purify the state institution from those they see as "destructive elements."

On the idea of the House of Representatives, it approved the bill to dismiss the employee by other than the disciplinary method, not to dismiss the Brotherhood’s employees.

Egypt is a state of law and does not use it to exclude anyone. Its legislation is abstract and committed to the rules of international humanitarian law. It deals in this law with specific facts such as..to follow 👇

Interestingly, some commentators have found that these amendments are more fair to those affected by them than they themselves face, and among those who say that they were harmed by the early pension law, they appealed to Egyptian President Abdel Fattah El-Sisi to amend their law so as not to deprive them of disbursing their pension before reaching 60 years, in While these amendments do not deprive the dismissed of the pension and reward.

Mr. President, we, your sons, the honorable state employees, support our country and we have the honor to do so. We suffer from the new early pension law to prevent us from disbursing a pension and a reward before reaching sixty, despite the existence of a 20-year service period. yaris

On the other hand, many objected to these amendments, and saw them as unjust revenge and in violation of the constitution, and a model for the authorities' attempts to escape from real crises that it failed to confront, the latest of which was the crisis of the Renaissance Dam that Ethiopia built, and which threatens Egypt's historical share in the waters of the Nile River.

Others also pointed out another aspect of harm in it, which is that it opens the way to the injustice of large sectors of citizens without real support, as the authority will depend in determining who belongs to the Brotherhood or terrorist organizations on security reports that open the way to malicious communications and settling accounts.

Others saw in the draft law a "racist" decision that would increase the societal rift and reinforce "classism" in society, noting that it excludes workers in the ministries of defense, interior and justice from being subject to its articles.

Those holding this opinion relied on the first article of the law, which says that it relates to the units of the state’s administrative apparatus, local administration units, and other parties, “without prejudice to the constitutional guarantees that may be prescribed for some groups in the face of impeachment.”

#Failed_Regime. Anything that feels trouble comes out with a law. The strange thing is that our people are relinquished and treat themselves, they do not understand.. The law of separating the brothers or sympathizers with them from state institutions is a message to the people with all their affiliations, the turn is coming.. for everyone #The Revolution

A law of racial segregation with a degree of privilege. Was the Brotherhood the ones who abandoned Tiran and Sanafir, or did they abandon the Nile River, or was it possible that they neglected Umm al-Rasrash, for example (Eilat) for the Zionists, or did the brothers neglect the Mediterranean gas? They increased corruption in it

Under these amendments approved in principle, the dismissal decision is granted to the President of the Republic or his authorized representative, in accordance with the text of Article Two of it, which says that “the dismissal of a worker shall be by a reasoned decision issued by the President of the Republic or his representative based on the presentation of the competent minister after hearing the worker’s statements, and the worker shall be notified dismissal decision.

Among the cases in which the draft law stipulates the permissibility of dismissal without a disciplinary procedure, “whoever has serious presumptions that affect the national security and safety of the country, and the inclusion of the worker on the list of terrorists is a serious presumption, or if he loses confidence and consideration,” according to what Parliament Speaker Hanafi Jabali read out during Introduced modifications.

The entry into force of the draft law requires its presentation to the State Council, to ensure that it does not violate the constitution, and then a re-vote on its articles by all members of the Council to obtain final approval, and in the event that is ratified by the President of the Republic, then published in the Official Gazette.

Since the military coup in July 2013, the new authority in Egypt has taken a series of measures against the Muslim Brotherhood, to which the ousted late President Mohamed Morsi belonged. The group was banned and classified as a terrorist group, and thousands of its members and leaders were prosecuted, and various prison sentences were issued against them, days ago. 12 people were sentenced to death, including leaders of the group, such as Muhammad al-Beltagy, Abd al-Rahman al-Bar, and former minister Osama Yassin.

The group constantly denies, in statements and statements by its leaders abroad, the validity of these accusations, and confirms that they are linked to its position rejecting the overthrow of the late President Mohamed Morsi, who was the first elected civilian president of Egypt after the January 2011 revolution that toppled former President Hosni Mubarak after 30 years in which he spent Authority.

After research.. I found that the websites that explicitly talked about this exception are not governmental means or are known to be close to the authority.. but they relied on the text of Article 1 in the approved amendments and it is present in governmental means and the text is:

Article (1), replaced by the first paragraph, lists the bodies for which employees or workers may be dismissed by other than disciplinary means, in a manner that includes units of the state’s administrative apparatus, units of local administration, bodies addressed by the provisions of the Civil Service Law, public service and economic bodies, public law persons, and sector companies. The general public, public business sector companies, and employees whose employment affairs are regulated by special laws or regulations, without prejudice to the constitutional guarantees that may be prescribed for some groups in the face of dismissal.
