The Chishui River, which flows through the three provinces of Yunnan, Guizhou, and Sichuan, is well-known for the feat of the Red Army's "Four Crossings of Chishui".

In fact, apart from the red mark, the importance of the Chishui River has another important meaning-as an important tributary of the Yangtze River, the Chishui River is an important habitat and breeding site for many rare and unique fishes, which is important for the construction of the upper reaches of the Yangtze River. The barrier is of great significance.

Today, this river of great significance has been protected by the joint legislation of the three provinces of Yunnan, Guizhou and Sichuan. After the joint efforts of all parties, the Standing Committee of the People’s Congress of the three provinces of Yunnan, Guizhou and Sichuan respectively deliberated and unanimously approved the proposal on strengthening the joint protection of the Chishui River Basin at the end of May. It was decided, and the respective Chishui River Basin Protection Regulations were reviewed and passed, and they were implemented simultaneously on July 1, opening a new situation for the three provinces to jointly protect the Chishui River Basin.

The joint legislation for the protection of the Chishui River Basin, as the country’s first joint legislation for local river basins, is an innovation in the form of local legislation.

On June 18, the General Office of the Standing Committee of the National People's Congress held a collective interview for this innovative move.

Relevant persons in charge of the Legislative Affairs Committee of the National People's Congress Environment and Resources Committee, the Legal Work Committee of the Standing Committee of the National People's Congress, and the Legal Work Committee of the Standing Committee of the People's Congress of Yunnan, Guizhou and Sichuan jointly answered questions from reporters.

Ou Lin, Director of the Bills Office of the Environmental Resources and Resources Commission of the National People’s Congress, pointed out that the Chishui River Basin Protection Joint Legislation is a practical action to implement the Yangtze River Protection Law and strengthen the ecological environmental protection and restoration of the Chishui River Basin in accordance with the law; it is the local implementation of river basin regional legislation to further promote ecological civilization. Exploration and innovation in the construction of the rule of law.

Joint legislation to solve the problem of "dividing rivers and governing"

In recent years, the three provinces of Yunnan, Guizhou and Sichuan have taken the lead in establishing a trans-provincial ecological compensation mechanism in the Yangtze River Basin, and the ecological protection and environmental governance of the Chishui River Basin have achieved positive results.

"However, due to differences in the functional positioning, industrial layout, protection methods, and law enforcement standards of the river basins in the administrative regions of each province, the problems of river basin management caused by the'division of rivers' are still more prominent, and it is necessary to promote joint protection with systematic concepts and legal thinking. "Olin said.

Under the guidance and promotion of the Standing Committee of the National People’s Congress, the Yunnan, Guizhou and Sichuan Provincial People’s Congresses established the Chishui River Basin Protection Legislative Secretary-General’s Joint Conference System, clarified the lead coordination mechanism, established a special class for joint legislation, held several symposiums and conducted field investigations to seek The largest legislative consensus.

Yang Jun, deputy director of the Legislative Affairs Committee of the Standing Committee of the Sichuan Provincial People's Congress, said that this joint legislation has achieved innovations in the form, content cohesion, and working mechanism of local legislation.

The three provinces jointly decided to "the same text, review at the same time, promulgate at the same time, and implement at the same time", realizing the leap from "linkage" to "co-existence" in regional legislation.

"Joint legislation solves the problem that it is difficult to specialize legislation for each river basin at the national level, promote coordination and cooperation of local governance, coordinate conflicts of interest in accordance with the law, promote joint protection of the water environment, strengthen common legal responsibilities, and jointly solve the ecological protection of river basins and regional economic and social development. The common problems in China have explored new ways and new models for joint legislation in local river basins, and provided new experience." Ou Lin said.

Yang Heqing, deputy director of the Economic Law Office of the Legal Work Committee of the Standing Committee of the National People's Congress, pointed out that the Standing Committee of the National People's Congress is continuing to promote river basin regional legislative work. It has included the Yellow River protection legislation in this year's legislative work plan, and relevant parties are speeding up the drafting of the draft.

In addition, it will also thoroughly summarize the innovative practices of local watershed and regional joint legislation, strengthen theoretical research, and summarize and refine experiences that can be replicated and promoted.

Refine the relevant provisions of the Yangtze River Protection Law

As my country's first river basin law, the Yangtze River Protection Law came into effect on March 1 this year.

The three provinces of Yunnan, Guizhou and Sichuan jointly legislate to protect the Chishui River basin, a tributary of the Yangtze River, which is a practical action to implement the Yangtze River Protection Law.

For example, Article 6 of the Yangtze River Protection Law stipulates that relevant localities in the Yangtze River Basin shall establish a coordination mechanism in the formulation of local laws and government regulations, planning, supervision and law enforcement, etc., to coordinate the promotion of ecological environmental protection and restoration of the Yangtze River Basin.

Ou Lin said that the joint legislation should be detailed and consistent with the relevant provisions of the Yangtze River Protection Law, adhere to the system concept, highlight the coordinated management of water resources, water environment, and water ecology, and integrate the protection and restoration of mountains, waters, forests, fields, lakes, and sand to effectively maintain the authenticity and integrity of the river basin ecosystem. Integrity, protect the unique natural, ecological and human environment of the Chishui River Basin, and provide legal guarantees for strengthening the comprehensive management, systematic governance, and source governance of the Chishui River Basin in accordance with the law.

"As the country's first provincial-level local legislation for river basin ecological protection across administrative regions, the object of this joint legislative adjustment is not only the ecological environmental protection of a certain province, but the joint protection and governance of the three provinces of the Chishui River Basin." Standing Committee of the Guizhou Provincial People's Congress Li Yong, deputy director of the Legal Work Committee, said.

Li Yong introduced that in the legislation of the three provinces of Yunnan, Guizhou and Sichuan, starting from the strategic thinking of protecting the entire Chishui River basin, focusing on the upstream and downstream industries, the left and right banks, and the industries between the main and tributary streams, from the perspectives of comprehensive river basin management, system governance, and legal governance. Difficulties and focus issues caused by inconsistencies in layout, development needs, environmental access, sewage discharge standards, environmental supervision and law enforcement, etc., focus on coordination and cooperation across administrative regions, joint prevention and control, and improve the coordinated protection mechanism of the three provinces with systemic thinking and the concept of rule of law , To form upstream and downstream linkages, trunk and tributary coordination, and left and right banks to promote the joint management of inter-provincial and cross-regional ecological environmental protection, and build a new pattern of joint protection of the Chishui River Basin.

Strengthen the co-governance of river basins and reflect their own characteristics

It is an innovation in the joint legislation of the three provinces of Yunnan, Guizhou and Sichuan to strengthen the co-governance of the river basin and reflect their own characteristics.

Zhenxiong County and Weixin County in the Chishui River Basin in Yunnan Province did not take a long time to get rid of poverty. The protection and governance tasks are heavy but the financial resources are severely insufficient. The local people are very concerned about the issue of ecological protection compensation.

Ma Chunwen, director of the Legal Work Committee of the Standing Committee of the Yunnan Provincial People's Congress, said that in response to the concerns of the masses, the local regulations of Yunnan Province make more comprehensive provisions on the issue of compensation for ecological protection.

At the same time, the regulations have refined and solidified the governance measures such as the demolition of small hydropower stations, sulphur slag remediation, and comprehensive fishing bans that have been carried out in the province in recent years to strengthen the pertinence and operability.

In order to strengthen the protection and inheritance of the unique red cultural resources of the Chishui River Basin, the regulations also stipulate the protection of the human and natural landscapes such as the former site of the Tashi Conference and the Grand Canyon of the Three Provinces of Jiming.

For example, Yang Jun cited the three counties of Xuyong, Gulin, and Hejiang in Sichuan Province from poverty alleviation to rural revitalization, and they are also red resource gathering areas.

Sichuan Province’s local regulations increase the integration of watershed protection with rural revitalization strategies and new urbanization strategies.

The special chapter stipulates "Cultural Protection and Inheritance", combining red cultural resources such as the "Sidu Chishui" site with education and training, rural revitalization and tourism development.

Li Yong said that the three provinces of Yunnan, Guizhou and Sichuan follow the principles and regulations jointly decided, and then use their respective protection regulations to refine the prevention and control measures and legal responsibilities for protecting the Chishui River Basin, and strive to solve how to protect and promote high quality in the administrative area of the province. The issue of development highlights the pertinence of legislation. "The innovative model of'decision + regulations' takes into account the common and individual issues of ecological environment protection and governance methods in the river basin, and opens up a new path for legislative guarantees to protect the ecological environment across regions." .
