On Thursday, the Court of Appeal announced the verdict in the high-profile case concerning a birth at CSK in Kristianstad in 2016. The boy Elliot was born with permanent brain damage and died just before his first birthday.

The cause of death has not been determined.

The mother Johanna Adolfsson reported the midwife to the police, who was brought to justice.

Last year, Kristianstad District Court sentenced the midwife for grievous bodily harm.

According to the court, the midwife gave pain-stimulating drops far above the guidelines, which caused a lack of oxygen in the child who was on his way out.

The midwife admitted that she had made a mistake during the birth but denied that she had committed a criminal act.

She was sentenced and the sentence became a suspended sentence and a daily fine.

The midwife chose to appeal the verdict to the Court of Appeal, which has now tried the case.

In the appeal, the defender Björn Hurtig emphasized that the midwife was hit hard by the district court's ruling, and that she also received criticism from the authority Ivo and was reassigned by the employer.

The Court of Appeal upholds the district court's judgment, but with the change that she does not have to pay a daily fine.

The care association has previously criticized that the incident led to a criminal case.

Malin Tillgren, chairman of the Healthcare Association in Skåne, has expressed concern that healthcare professionals are being prosecuted for mistakes in healthcare, when their actions are already being reviewed by Ivo and the Health and Medical Care Responsibility Committee.

Elliot's mother Johanna Adolfsson saw the district court's conviction as a restitution.
