June 17, 2021 The collection of signatures for the Referendum on Legal Euthanasia starts today (500,000 signatures by September 30) with the stories of those who, together with the Luca Coscioni Association, ask for freedom of choice over their lives. During the meeting, the video message of Daniela, 37, from Puglia, suffering from a severe form of pancreatic cancer, was transmitted, who would have liked to have been able to choose to put an end to her suffering, but did not have time to go to Switzerland to resort to assisted suicide. Daniela wanted to be "free to die in the best possible way" alongside her loved ones. He had contacted the Luca Coscioni Association and in February he had asked the ASL of Rome, where he lived, and the related Ethics Committee, the verification and certification of the necessary conditions to be able to appeal - in application of the sentence 242/2019 of the Constitutional Court - to the assisted suicide. The negative response caused Daniela to challenge the denial received and, thanks to the defense coordinated by the lawyer Filomena Gallo,Secretary of the Luca Coscioni Association, urgently appeals to the Court of Rome to obtain the checks required by the Cappato ruling. The hearing is set for June 22nd. Given the urgency of the case, they are asked to anticipate the decision but no one has ever replied. Daniela died on June 5th. Among the other sick people assisted by the Luca Coscioni Association, there is Mario (invented name) who had been denied by the ASL and the Court the possibility of accessing the procedure provided for by the Sentence 242/2019 of the Constitutional Court in order to be able to resort to assisted suicide. It is news of these hours that, with a new historical order (the first of its kind in Italy) the Court of Ancona overturned the decision of the previous judge, requiring the ASL to verify the patient's conditions to access assisted suicide, implementing made the Cappato sentence. The Referendum for Legal Euthanasia was filed on the initiative of the Luca Coscioni Association last April 20 in the Court of Cassation.



The text provides for a partial repeal of art. 579 of the Criminal Code ('murder of consenting'), which prevents the implementation of what is commonly understood by 'active euthanasia' (on the Dutch or Belgian model). In case of approval, we would pass from the model of the 'unavailability of life', sanctioned by the penal code of fascism in 1930, to the principle of the 'availability of life' and individual self-determination, already introduced by the Constitution, but which must be translated in practice, even for people who are not dependent on life-sustaining treatments (for which the Constitutional Court has instead intervened with the Cappato - Antoniani sentence).
