Courts The Supreme Court halves Juana Rivas's sentence for child abduction, who remains in two and a half years in prison
Juana Rivas has left the
Matilde Cantos
de
Granada
Social Insertion Center
(
CIS
)
this Tuesday
to serve a sentence at her home with telematic control, according to prison sources have informed Efe.
Rivas entered the CIS on the 11th to serve the sentence of two and a half years in prison that was imposed on him for not having delivered his children to the father in the summer of 2017.
At the proposal of the
Treatment Board of
that center, the
General Secretariat of Penitentiary Institutions
classified the inmate in third degree and applied article 86.4 of the Penitentiary Regulations, which means serving the sentence at home with a telematic bracelet.
For that decision, and as established by the regulations, the voluntary admission of
Juana Rivas
to the CIS
has been taken into account
, that the sentence imposed on her was not more than five years, that it is her first crime and that its cause it is older than three years.
To all this is added his social adaptation and the family support that he enjoys, other requirements that the penitentiary regulations establish in order to be able to grant a third degree in an open regime.
Direct access to the third degree is regulated by an Instruction of 2007 approved when
Mercedes Gallizo
directed the General Secretariat, and telematic control by one of 2019.
The General Secretariat headed by
Ángel Luis Ortiz
is betting, whenever criminal and penitentiary circumstances allow, for the execution of sentences in an open environment, as the head of this body has repeatedly emphasized.
