The nursery school backing onto the Meinau mosque in Strasbourg could well be authorized to open its doors.

The Strasbourg administrative court said on Friday that it had temporarily suspended a prefectural decree refusing its opening to an association linked to the construction of the Eyyub Sultan mosque, at the heart of a violent controversy last March.

"The judges of the summary proceedings decided that the prefect of Bas-Rhin had to make a new decision after a new examination of the association's request within a period of one month", explained the court in a press release.

The latter had been approached by the Vision association after the refusal of the Bas-Rhin prefecture, in a decree of March 30, to grant him an authorization for the opening at the next school year of a private nursery school outside the contract, baptized Eyyub Sultan.

"Short-term suspension of an administrative act"

Within the framework of this summary suspension, a procedure which allows the suspension within a short time of an administrative act, the judges cast doubt on the constitutionality of an ordinance dating from 1873, when Alsace was German, on which is based the prefectural decree. The order of the administrative court, which has yet to rule definitively on the legality of the order, can be appealed to the Council of State. Asked by AFP, the prefecture did not immediately react.

The leaders of the Vision association are also those of the local association Millî Görüs (CIMG Est), which is responsible for the construction of the Eyyub Sultan mosque.

Millî Görüs was at the heart of a violent controversy between the State and the city of Strasbourg after the vote on March 22 by the city council on the principle of a possible subsidy of 2.5 million euros for the construction of the mosque.

Millî Görüs had finally preferred to give up requesting this grant, avoiding the city of Strasbourg to have to decide definitively on its granting.
