The investigating judge of the macrocause of the ERE continues to collect information on the largest cause of corruption ever investigated in Andalusia due to the volume of the alleged fraud, which rises to
679 million
euros, the number of investigated -there were more than 500- and the separate pieces in which the cause has been broken off -more than a hundred-. The EREs deal with the system established for a decade by the previous Andalusian governments of the PSOE to distribute without control, in an opaque way and with
clientelistic criteria,
millionaire aid to workers and companies in crisis.
Now, the reinforcement magistrate of the Court of Instruction 6 of Seville,
José Ignacio Vilaplana
, in charge of the ERE case, has issued an order, advanced by
Abc
and held by EL MUNDO, in which he puts the unions in the spotlight UGT and Workers' Commissions, both at the national and Andalusian level, as well as to
some thirty of their
Andalusian
federations
and also at the national level.
The unions played a key role as intermediaries and alleged
receivers of commissions
in the framework of the ERE aid that was distributed by the Andalusian Government and that came from the also known as the
reptile fund
.
Now, the examining magistrate leads both unions and asks both the Government and the Junta de Andalucía for data on the "certifying or justifying their
legal personality
, indicating the date of acquisition or termination", in accordance with the provisions in Organic Law 11/1985 on Freedom of Association, and Royal Decree 416/2015, of May 29, on the deposit of statutes of trade union and business organizations, says the ruling.
Likewise, the investigating judge of the ERE requests the "certification accrediting the NIF" of the union entity and the "certification accrediting the
domicile
" of the UGT and CCOO, in addition to their federations.
To collect these data, Vilaplana has contacted the Ministry of Labor and Social Economy, led by Minister
Yolanda Díaz
(United We Can) and the Andalusian Ministry of Employment, Training and Self-Employed Work, led by Minister
Rocío Blanco
(Citizens).
Civil liability
Judicial sources specified to this newspaper that the judge's order seeks to collect these data from the
majority unions in
order, if necessary, to have all the information available and updated, in case it has to decree some type of subsidiary civil liability of UGT, CCOO or their federations in some of the pieces detached from the macrocause of the ERE.
The judge's request for information has been channeled through what is known as the
matrix piece
of the ERE, the preliminary proceedings number 174/2011. This is the first case that was opened on January 19, 2011 by the Seville judge Mercedes Alaya and which is currently practically without content because all the investigations and proceedings carried out were derived to the separate pieces that were opened: one for each help from the ERE . The main cause has been kept open to receive the
police reports
there
and then forward them to the corresponding cause.
The judicial sources consulted clarified that the judge's ruling on the unions does not mean that this case is going to be expanded, but simply that it has been processed from it and then distribute the information that arrives in the cases that require it.
During the investigation of the ERE case, Judge Mercedes Alaya estimated at
4.2 million
euros the
"overcommissions"
that she considers illegal, coming only from the consulting firm Vitalia, which managed the ERE together with the firm Uniter. The plants charged between 0.5% and 1% of each ERE through their insurance brokerage agencies Atlantis Asesores and Temiqui. Although those responsible for CCOO and UGT denied that they collected from the ERE, in the case of
Delphi
, each union center allegedly received
one million euros
, through the consultancy Uniter.
Among the thirty federations in the judicial focus are the Textiles, Chemicals and Allied State level;
that of Industry;
and Metallurgy, all of them from CCOO, among others.
The UGT includes the Agrifood at the state level and Metal, among others.
