May 10, 2021 "By law, Rousseau cannot absolutely communicate the lists of members to people other than the legitimate legal representative or even, as requested, to people not even members of the Movement". Thus the association in a post in which it adds: if it communicated the data "to a third party", it would violate the "Privacy Code which provides up to the penalty of imprisonment for unlawful communication and dissemination of personal data being processed on a large scale. this is not even possible to communicate the list to a new political force that has a different association with a different Statute and a different symbol ".

"The data of the subscribers belong to the subscribers themselves. It is they who must be able to freely decide on the use of their data. Nobody can decide arbitrarily for them. Neither Rousseau (who in fact has no intention of doing so and who at the moment manages exclusively as data processor), nor other unauthorized persons who, on the other hand, had to demand its delivery ", claims the association led by Davide Casaleggio, who recalls:" All those who have decided to join the 5 Star Movement have expressed the clear desire to join the Movimento 5 Stelle Association and its Statute which provides that the owner of the data is the Movimento 5Stelle in the figure of the legal representative. Only and exclusively to the latter,ie to the legal representative of the 5 Star Movement, the Rousseau Association, as data processor, is authorized to communicate the lists of the 5 Star Movement members to no one else ".

Between the M5s and Rousseau "we are sure a legal solution will be found and we are the first to want it, but the press announcements without in-depth analysis of these solutions are of little use and in some cases irresponsible and harmful. We therefore wait for the table, at which we have been sitting for 15 months, someone with the concreteness and the will to solve the problems they have generated ", continues the blog post of the Stars.

"Asking to violate the law by communicating the data of the members to unauthorized persons is an act that leaves us disconcerted and the fact that media and personal pressures are put in place aimed at pushing us to violate the privacy legislation is inadmissible for us", protest again the association chaired by Davide Casaleggio, who adds: "We have always been available and always will be, but respecting the law and not violating it as some NO LEX would like to do. We want to solve problems and do it in a serious and serene way".
