They do not call them "penalties" but "educational measures" since the objective is to re-educate them to prevent them from committing a type of abuse that is as unknown as it is silenced. And it is that many parents do not want to see how their children have taken control and subjected them to harassment to fulfill their wishes, even verbal or physical abuse. Last year in Catalonia 8% of minors who go through juvenile justice do so for habitual attacks on parents or guardians. In total
there were 435 young people
, mostly boys and of Spanish nationality.
After the sentence of a Juvenile Court accrediting the crime of mistreatment of a child to his parents, he is offered four possibilities: On the one hand, he can be on probation, sleeping at home with his parents and with weekly monitoring by a psychologist, who sets goals and a timetable to achieve them; the second, that he goes to live with a relative; the third, living with a host family, and the fourth, living in an apartment like the ones the Generalitat has in Girona or Barcelona.
Young people between the ages of 14 and 18 reside in these flats who have routinely abused their parents, mainly mothers, and the fact is that violence is also a gender issue in this area. These physical attacks are accompanied by threats, insults, coercion and other forms of psychological abuse. In most cases, child-parent violence is related to highly impulsive behaviors and mental health problems, triggered or aggravated by drug use, mainly marijuana.
While they comply with the "measures" imposed, young people lead a normal life.
Every day they go out to study and when they return to the shared apartment, they work on some basic rules of coexistence and
take responsibility for housework
: making bed, cleaning, agreeing on menus, shopping and cooking.
In parallel, they receive the care of psychologists and social educators of the Department of Justice of the Generalitat who live with them, in the same home, both day and night.
A parenthesis
Precisely, the professionals who live with the minors work with the coexistence group and with the families. They identify the origin of the conflicts and the triggers of the violence. Throughout the process, psychologists mediate between the parties, facilitating the acceptance of facts, the admission of mutual mistakes, and apologies. The job is to provide the tools to anticipate, avoid and manage conflict before violence breaks out.
These shared flats are a "parenthesis in coexistence with the family, to end an extreme situation, of great stress, both for parents and children", they explain from the Department of Justice that they remember that the objective is to redirect behavior and rebuilding family relationships "with clear boundaries, respectful and emotionally rewarding."
The average length of detention is between nine and fifteen months and is established in the sentence.
New facilities
Four years ago the Department of Justice created this service. At the moment there are two units for young people who have committed crimes of filioparental violence: One is the one in Girona, created in 2018 with a capacity for six people and the other in Barcelona that was launched in 2017, with a capacity for five people. These are services that
are located within cities, so that minors can redirect their behavior without breaking with their
daily
social relationships
, according to the Department. In addition, the creation of new child-parent violence units is being prepared in other Catalan demarcations in the coming years.
The center of Girona has recently moved to a larger apartment with the capacity to double the number of places. Unlike the old ones, the new buildings have direct entrance from the street, without the security measures of the closed facilities, which are enclosures for minors who have committed more serious crimes. and an open center for third-degree prisoners was created.
They are apartments of 300 square meters that have been renovated to function as a flat or a student residence.
For now, the Girona unit maintains the same number of places, but next year Justice will take advantage of the new facilities to create a second unit for six more minors.
Therefore, in 2022, the floors of the old prison will house two units, with a total of twelve young people.
In this way, it will be possible to
improve the care in this treatment that aims to correct a type of hidden and latent violence
that can end the life of a family in the face of the difficulties of knowing how to act when your own child is your abuser.
