  • Measures End of the state of alarm: restrictions from May 9

The

Community of Madrid

has not yet decided what

restrictions it

will maintain as

of May 9

, when the

state of alarm

ends

, since it is analyzing the legal possibilities to give continuity to those that limit fundamental rights, such as mobility.

Sources from the Ministry of Health have indicated that they are studying the

decree

approved on Tuesday by the Council of Ministers that opens the door for an autonomous government to

present an appeal before the Supreme Court

if the Superior Court of Justice (TSJ) of their community does not authorize the measures that it agrees to fight against the

coronavirus

after May 9.

For its part,

the Prosecutor's Office will study case by case

the application of the

restrictions

agreed by the autonomous governments, so that it will not establish a general criterion of action, since it wants that position to be established as soon as possible by the Supreme Court, which

from 9 May will have the last word

.

At the moment, until May 9, the

curfew

is in force in the Community of Madrid

from 11:00 p.m. to 06:00 a.m., as well as the

prohibition of meetings of non-cohabitants in homes

, except for exceptions such as care for elderly dependents, minors or vulnerable people.

In addition, the

Community of Madrid

maintains its strategy of

restricting mobility in areas

with a high incidence of coronavirus, measures that are in force in 16 basic health areas and two localities where 451,949 citizens live, 6.7% of them the population of the region.

The

Community of Madrid

has registered 19 deaths from

Covid

in hospitals

this Wednesday

, the same figure as on Tuesday, and although hospital pressure has dropped, new infections have increased after the bridge, causing the total of confirmed positives to exceed the barrier than 700,000 since the start of the pandemic.

The general director of Public Health, Elena Andradas, expressed on Friday the intention of

maintaining these restrictions by basic areas

, while the Deputy Minister of Public Health and

Covid-19

Plan

, Antonio Zapatero, did not rule out continuing with others such as with

the curfew

if necessary, depending on the evolution of the data.

Judicial ratification after the

state of alarm

would only be necessary for measures that affect fundamental rights, such as

mobility restrictions

, and not for others related, for example, to limitation of hours or capacity.

In fact, the Minister of Health, Carolina Darias, explained this Wednesday after the Interterritorial Council of the National Health System that the restrictions that prevailed before the declaration of the last

state of alarm

, such as limiting hours to hotels and commercial establishments, the closure nightlife or the ban on smoking in the street without a safety distance, will be in force again from May 9.
