  Among them, the excessive development of Changyao Mountain in Jinning, Kunming, Yunnan has seriously affected the integrity of the ecosystem of Dianchi Lake. The specific circumstances of this typical case are as follows:

basic situation

  Changyao Mountain is located on the south bank of Dianchi Lake. It is an important part of Dianchi's landscape, forest, field, lake and grass ecosystem. It is an important natural landscape of Dianchi. It was once an important urban ecological isolation zone in Kunming. It plays a very important role in conserving the good ecology of Dianchi.

Since January 2015, Kunming Nuostar Enterprise (Group) Co., Ltd. (hereinafter referred to as Nuostar Group) has successively started construction of the Dianchi International Health Care Resort Project in the Changyaoshan area.

According to the survey, the project is planned to cover an area of ​​3426 mu, accounting for about 92% of the total area of ​​Changyao Mountain. It is planned to construct 813 villas and 294 multi-storey and mid-high-rise buildings with a construction area of ​​2.252 million square meters.

Among them, 390 villas and 25 multi-storey and mid-high-rise buildings are planned to be built in the Dianchi Lake area.

At present, all planned projects have been implemented, and the ecological function of Changyao Mountain has basically been lost, which has affected the authenticity and integrity of the ecology of the Dianchi Lake.

——Illegal occupation of Dianchi Lake Reserve

In July 2016, the first round of central ecological and environmental protection inspectors pointed out that related projects constructed by Nuo Shida Group invaded the Dianchi first-level protection zone.

However, Jinning District and Nuo Shida Group not only failed to learn their lessons seriously, but intensified their efforts. They destroyed the ecological forest and built an asphalt road in the Dianchi first-level protection zone, and successively developed and constructed real estate projects in the restricted construction area in the Dianchi second-level protection zone. As of July 2018, when the first round of central ecological and environmental protection inspectors "looked back", 167 villas have been built in the secondary protection zone, covering an area of ​​293 acres and a construction area of ​​108,000 square meters.

The area of ​​Changyao Mountain adjacent to Dianchi Lake (Dianchi second-level protection zone) is undergoing extensive excavation, which has severely damaged the original natural ecology and occupied the ecological space of Dianchi Lake.

In November 2018, the Standing Committee of the Yunnan Provincial People's Congress revised and passed the "Regulations on the Protection of Dianchi Lake in Yunnan Province", stipulating that ecological tourism and cultural projects such as healthy elderly care, fitness and leisure can be built in the restricted construction area of ​​the Dianchi secondary protection zone.

Nuoshida Group "borrowed the donkey on the slope", more unscrupulous, immediately under the guise of the health and elderly care industry, continued to build 437 villas in the second-level protection restricted construction area of ​​Dianchi Lake, covering a total area of ​​1,242 acres and a building area of ​​400,000. Square meters.

According to the investigation, the property rights of these villas are listed as “market-oriented commercial houses” in the “Nature of Rights” column, and the single set of online signature filing price is between 2.18 million and 29.92 million. It is not a declared health care project, but actually a health care pension. The name of the industry is the real estate development.

The real estate certificate of a house in this project shows that the nature of its rights is "market-oriented commercial housing", the source of the property rights is "commercial housing trading", and the construction area is 494.44 square meters.

——The ecological function of Changyao Mountain is basically lost

  In addition to the aforementioned real estate projects located in the second-level protection area of ​​Dianchi Lake, between 2017 and 2020, Nuostar Group has also successively constructed 209 villas, 294 multi-storey and mid-to-high-rise real estate projects in the third-level protection area of ​​Changyao Mountain, covering a total of land 1,891 mu, with a construction area of ​​1.744 million square meters, and the entire Changyao Mountain has been completely developed.

Field investigation found that a large number of retaining walls severely damaged the topography of Changyao Mountain. The original ditches and creeks were all hardened by cement, and the woodland, grassland, and arable land were all turned into cement.

Over 90% of Changyao Mountain is packed with densely packed buildings. The entire mountain body is tightly wrapped by reinforced concrete, which basically loses its ecological conservation function, and Changyao Mountain has become a "cement mountain".

Changyao Mountain faces the area of ​​Dianchi Lake (Dianchi Lake Grade II Protection Area), which has been partially built and a large number of villas are under construction.

  The inspector also found that the problem of "tracking development" in the Caohai area of ​​Dianchi Lake was prominent, and a large number of real estate projects competed with the lake for land. "Increase of land must be contended" and "not yielding every step". The 25-kilometer lakeside area around Caohai was occupied by real estate projects.

Since 2015, the Caohai area has developed and constructed 42 plots, covering an area of ​​2,463 mu, with a construction area of ​​4.759 million square meters.

  Recently, the main responsible comrades of the Yunnan Provincial Party Committee and the Provincial Government conducted on-site supervision of the protection and management of Dianchi Lake, and proposed rectification measures for the excessive development of Changyao Mountain.

Cause Analysis

  The news pointed out that the local party committee and government have a low political position, their attitude towards the protection and governance of Dianchi Lake is not resolute, their actions are discounted, the standards are not high, and the requirements are not strict. In the long-term account, the relationship between development and protection has not been properly handled, and Dianchi Lake has not been protected like the eyes.

Kunming's delay in compiling and issuing Dianchi protection plans in accordance with the requirements of the "Dianchi Lake Protection Regulations of Yunnan Province" has resulted in the long-term lack of "regulations" for Dianchi Lake protection, and the phenomenon of "development around the lake" and "tracking development" of Dianchi Lake has intensified.

The relevant functional departments of Yunnan Province did not perform their duties in place, and failed to promptly point out and stop the illegal development and construction of Changyao Mountain and other areas in Dianchi Lake.
