The Government will not extend the state of alarm that expires on Sunday, May 9.

There will not be a legal 'plan B' as demanded by the opposition and a large part of the communities, but the Executive has decided to open a new channel so that the regions can restrict fundamental rights, such as the mobility of citizens, in the fight against pandemic.

They may go to the Supreme Court to request these measures.

Until now, without the umbrella of the state of alarm, the communities must request judicial authorization, from the higher courts of justice, for those measures that may imply a limitation of rights.

That was the route articulated by the Executive.

This led to a disparity in criteria and decisions: closures, equal measures that were approved in one community and were overthrown in another.

And there the margin of the communities ended.

The Council of Ministers has approved in its meeting this Tuesday that in the event that the higher courts of justice overthrow the decisions of the autonomous governments, they can appeal to the Supreme Court for a ruling, as confirmed by sources from the Ministry of Justice to this newspaper. .

This route, which was previously not validated, will mean that the High Court can establish doctrine in this regard and when it makes a decision, a judicial roadmap can be drawn up on what the autonomies can and cannot.
