• Courts claim to seize assets from JxCat for the conviction of Convergència for the 'Palau case'

The Audiencia of Barcelona has begun the search for the heirs of Convergència Democràtica de Catalunya (CDC) to prevent the conviction against this formation from going unpunished for the diversion of funds from the Palau de la Música when Fèlix Millet and Jordi Montull were in command. It is one of the last procedures known as the 'Palau case' that ended with prison sentences and a fine for the main defendants, including the formation created by Jordi Pujol. Now, the court upholds the request of the Fundació Orfeò Català-Palau de la Música and opens a separate piece in the process of execution of the sentence to determine if Junts Per Catalunya and PDeCat are the succession of the Convergència Democràtica de Catalunya (CDC) and they must face civil liability.

Thus, the magistrates urge these two formations to appear in person in the procedure and to present allegations at the request of the Palau de la Música so that they pay the missing amounts. Specifically, in the sentence of the 'Palau case' it was estimated that the CDC had to return 6.6 million euros allegedly diverted from the cultural entity to the party and collected in exchange for the award of public works when Pujol ruled in the Generalitat.

After the conviction was final, a year ago, the Barcelona Court ordered the preventive embargo agreed in the civil liability piece regarding the confiscation of the profits obtained by CDC for the amount of 6.6 million euros that had to be paid to the affected entities . The appraisal of the fifteen venues that the CDC made available to the court is appraised at 3.6 million euros "a much lower amount" than the money that is claimed from the party "for confiscation of the illicit profits obtained", according to the order that adds that "the auction of immovable property seized in no case would cover the amount subject to condemnation."

For this reason, the Palau de la Música demanded from the Audience of Barcelona that the remainder that remains to be paid be requested from PDeCat and Junts Per Catalunya, since it considers them "political heirs of the CDC". Now the court has started the investigation of the Convergència succession, taking into account that the party filed a voluntary bankruptcy on March 30, 2020 in the Mercantile Court number 9 of Barcelona, ​​which states that "there is no other assets to seize to CDC by having joined the mass of creditors ".

In this sense, the Commercial Court filed a conflict of jurisdiction with the Barcelona Court regarding the destination of the seized assets in the execution piece, whose resolution is pending in the Special Chamber of the Supreme Court.

If the aforementioned Chamber "decides in favor of the preference of the Commercial Court of the seized assets in this procedure, they would become part of the mass of creditors with preference for the bankruptcy creditors."

For this reason, the Audiencia of Barcelona opens the succession piece and urges Partit Demòcrata Europeu Català (PDECAT) and Junts per Catalunya, to present allegations.
