Frankfurt / Main (dpa) - In the legal dispute over the "organic" label for mineral water, the beverage manufacturer Neumarkter Lammsbräu has won a legal victory.

In a ruling by the Frankfurt Higher Regional Court, the Fresenius Institute and the Danone Group are prohibited from awarding or using the label “premium mineral water with organic quality” for its product “Volvic”, as a court spokeswoman said.

As a justification, the court pointed out, among other things, that buyers expect significantly purer and untreated water if it is referred to as "organic".

In fact, there is follow-up treatment in the present case.

The verdict is not yet legally binding.

In the first instance, Neumarkter Lammsbräu had failed.

The company has now welcomed the verdict in a press release.

The tried and tested organic principles also have to be strictly adhered to with water.

The seal is awarded by the SGS Institut Fresenius.

A spokesman said on request that the judgment was incomprehensible, especially since the court had stated at the last hearing that the seal was basically not objectionable.

Now the reasons for the judgment must first be awaited.

A spokeswoman for Danone also said on request that the verdict was incomprehensible.

Danone will wait for the reasons for the judgment and then explore the possibilities for an appeal before the Federal Court of Justice (BGH).
