The Federal Supreme Court upheld an appeal against a ruling that sentenced a foreign and Gulf man to four months in prison on charges of improving sins, and decided to refer their case to the Court of Appeal for its consideration again, because the judgment issued against them was invalid, given the change in the law related to their case, and the court ruled their innocence and canceled the judgments against them.

The facts of the case go back to when a phone shop in Fujairah informed about a person who defrauded him by repairing his phone and escaping without paying the account, after the owner of the shop was deluded that he would return after five minutes, but he did not return.

The owner of the shop sought the help of the police to restore his right from the fugitive customer, and the police sought to review the videos recorded by the surveillance cameras installed in the shop, and the suspect’s brother was identified and permission was obtained from the Public Prosecution to raid the house in order to arrest the accused. A Gulf woman who does not have any legal connection.

The Public Prosecution charged them with two charges of adultery and improving the sin, and committing an order that would tempt them to commit it by being with each other without having any legal relationship, and referred them to the court, while the court of the first degree in presence, unanimously, decided to imprison the defendants for six months and deport the first accused from the state after the execution of the punishment. With regard to the charges brought against them after their admission.

The Court of Appeal ruled to reduce the sentence on the defendants from imprisonment from six months to four months and uphold the ruling to deport the first accused after the execution of his sentence.

The Federal Supreme Court upheld their appeal and decided to return the case to the Appeals Court in Fujairah to retry them. After the case was discussed, the court ruled their innocence and canceled the rulings against them due to the application of the new article of the law.
