With the votes of the CDU, CSU and SPD, the Bundestag decided on the federal emergency brake after a long debate in plenary.

342 MPs voted in a roll-call vote for the emergency brake, 250 against and 64 abstained.

The amendments to the law give the federal government the power to order contact restrictions and closings.

So far, the federal states are responsible for this.

The emergency brake should be pulled if the number of reported new infections per 100,000 inhabitants in a district or a city is over 100 within seven days for three days in a row.

A higher threshold of 165 should apply for switching to distance learning in schools.

The changes to the Infection Protection Act should go to the Federal Council this Thursday and come into force quickly - initially by the end of June.

Criticism came from the opposition.

The FDP party and parliamentary group leader Christian Lindner announced a constitutional complaint against the amendment to the Infection Protection Act.

"We see the rules on curfew unchanged under constitutional law as highly problematic," he told the RedaktionsNetzwerk Deutschland (RND).

“We therefore want to see the legality checked in Karlsruhe.

The curfew is not necessary to fight the pandemic, but it is an encroachment on fundamental rights.

In addition, the law lacks the distinction between vaccinated and non-vaccinated. "

Lindner criticized the Greens, who shared this criticism but did not reject the law "despite their concerns about compatibility with the Basic Law".
