• The investigation The judge 'resurrects' the training scandal and processes former PSOE officials in the Junta and its former mayor in Granada

  • Courses The judge sees fraud in Board contracts for three years

  • Invercaria case Carpetazo to a piece of the Invercaria corruption case that had been under investigation for nine years

Again a

conflict of interest

of the Junta de Andalucía, governed by the PP and Ciudadanos, in a legal case for alleged administrative corruption that comes from the previous stage of the Andalusian socialist governments.

This time it is a case that the Court of Instruction 6 of Seville has been investigating since 2013 on alleged crimes of prevarication,

fraud in administrative contracting

, prohibited negotiations for officials and documentary falsification related to various contracts made by senior officials of the Board, in the stage of the governments of the PSOE, to supervise and control

professional

training courses

.

The period under judicial scrutiny focuses on the years 2010, 2011 and 2012, when the president of the Board was the socialist José Antonio Griñán, already convicted by the Seville Court for the ERE case, although the ruling is not final, since that is appealed in the Supreme.

The judicial case on which the conflict of interest now hangs is already in the final stretch of the investigation and in it, 19 officials, workers and former high-ranking officials of the Board appear as investigated -before defendants, among them the former socialist mayor of Granada

Francisco Cuenca

, for his time as delegate of the Department of Innovation in Granada.

The complainant in this case was the

Andalusian Union of Officials

(SAF).

Now, the lawyer of the Board has asked the investigating judge to impose on this union a

bond of 120,000 euros

so that it can continue in the judicial case, as reflected in a letter dated March 12 from the Legal Cabinet of the Board that it had access THE WORLD.

"We find it shameful" that the Andalusian Government, chaired by Juanma Moreno, "

is maneuvering

through the Board's Legal Cabinet to expel the SAF" from a legal case that denounced this union, warned Carlos Sánchez, president of the Andalusian Union of Officials .

Precisely this union warned about the alleged usurpation of public powers and the irregular contracts to supervise the courses when the PSOE ruled in Andalusia.

“And now, this government of change, instead of letting the Justice investigate and prosecute,

does the dirty work

for those who previously governed.

Luckily they came to regenerate public life, "added Sánchez.

The legal case regarding the irregular contracts to companies to inspect the training courses is at a

delicate procedural moment

. A little over a year ago, the reinforcement judge of the Court of Instruction 6 of Seville,

José Ignacio Vilaplana

, prosecuted 19 former high-ranking officials, officials and company workers, but at the end of last November, the Prosecutor's Office formulated its indictment and excluded from him ten of the 19 people tried in the case, among them the former mayor of Granada. Therefore, for the prosecutor, these ten people did not commit any crime and should not go to trial.

On the other hand, the Andalusian Union of Officials has filed an accusation against the 19. Francisco Cuenca faces a request for a sentence

of two years in prison

and 10 years of disqualification from employment or public office. If the accusation exercised by the SAF leaves the judicial process due to the imposition of a high bail that it cannot face, possibly,

only the nine defendants

accused by the Prosecutor's Office

would sit

on the defendant's

dock

. In other words, ten people who have been investigated - among them the former mayor of Granada - would be exonerated and even free from going to trial.

The conflict of interest of the Board that denotes this matter has already been seen in several cases of corruption, such as the ERE or more recently in Invercaria, the public venture capital company that, during the stage of the previous Andalusian socialist governments, made investments dilapidated and uncontrolled in failed business ventures.

One of the cases detached from the macro-case of Invercaria, that of

Kandor Graphics

, was shelved because the only accusation that remained in this case was that of the Popular Party.

At the same time that the PP saw signs of crime, the Board's Legal Cabinet did not appreciate any crime.

The obvious contradiction even led the Anti-Corruption Prosecutor's Office to qualify as "schizophrenic" the procedural position of the Andalusian Government, compared to that of the PP.

This conflict of interest eventually caused the case to be shelved.

In the ERE, the Andalusian Government has also had to give explanations in Parliament, through the counselor

Elías Bendodo

, for requesting the file of the case for several former senior officials of the Socialist Board.
