  • The parents of a 17-year-old girl, raped in Isère in October 2020, have decided to initiate a liability action against the State for "gross negligence".

  • The suspect had been released from prison five months earlier for health reasons.

  • The sentencing judge, who took this decision, argued the need to reduce the prison occupancy rate to limit the consequences of a possible spread of the virus within the prison.

  • For the lawyer of the parents of the victim, there was "obviously a dysfunction of the judicial authority".

A drama that could have been avoided.

This is the feeling of Anne-Lise's parents.

The girl was raped and threatened with death when she was 17.

It was October 24, 2020 at a party to which she had been invited.

The attacker was present in the apartment, she did not know him.

His parents, who live in Isère, have decided to take legal action (the Paris court in this case) in order to initiate a liability action against the State for “gross negligence”.

The reason ?

They believe the suspect should never have been released from prison.

However, he was released five months before the tragedy, even before having served a four-year prison sentence to which he was sentenced on December 18, 2018.

Make room in prison

"The criminal record of Mr. S. contains 8 mentions," recalls Fabien Rajon, the couple's lawyer from Lyon.

The last actually dates back to 2018 with this conviction for sexual assault, arbitrary detention, forcible confinement and the very violent assault of his companion (having suffered 120 days of ITT).

He was released on November 20, 2021. "

But the suspect left his cell at Corbas (Rhône) remand center in May 2020, eighteen months earlier than expected.

The sentencing judge who ordered his release, motivates his decision by "the health situation linked to the Covid-19 epidemic".

A situation requiring that the occupancy rate of the establishment of 130%, "be reduced, in order to limit the consequences of a possible spread of the virus" within the remand center, he argues.

"My clients are amazed to learn that this individual who raped and threatened with death their daughter, was released on the grounds of the fight against the coronavirus," explains Fabien Rajon.

They are all the more amazed to learn, on reading the wording of this decision, that the risk of recidivism was not excluded.

And that the man also presented tendencies to the passage to the hetero-aggressive act.

"

"There is clearly a dysfunction of the judicial authority"

For the lawyer from Lyon, "there is clearly a dysfunction of the judicial authority".

"This individual was released without a hearing or contradictory debates," he recalls.

Sometimes there are no contradictory debates but we are not in the presence of detainees who have this type of profile ”.

Incomprehensible, according to the lawyer, recalling once again that the judge of the application of sentences was nevertheless aware and aware of the "repeated risk of sexual assault".

The suspect is again imprisoned at Corbas remand center.

He has been remanded in custody since his indictment for the rape of Anne-Lise.
