In the specific case, a driving school tried to receive compensation from the city for losses suffered due to the corona restrictions.

According to the tax authorities, the Hamburg Regional Court decided that the plaintiff could neither derive compensation claims from the Infection Protection Act, on the basis of which the ordinance was made, nor from other legal bases.

The operator of the driving school, however, can appeal to the Higher Regional Court.
