Assignment review may reveal that the Swedish Agency for Economic and Regional Growth has repeatedly made a number of incorrect decisions regarding short-term support to companies during the corona pandemic.

One of the errors concerns the so-called "comparison month" - which is used to see what salary level the employees at an applicant company have been at.

The authority uses the wrong month and does not follow the law, according to both the administrative court and the court of appeal in Stockholm.

No money despite them

In June 2020, Lars Klingström applied for short-term support for his company for the period June to August - but was rejected.

- They looked at a comparison month that we thought was strange.

Then we started looking and counting ourselves and came to the conclusion that this does not feel like the right decision, says Lars Klingström.

The decision was appealed to the administrative court in Stockholm, which upheld Lars Klingström.

The wrong comparison month had been used and the case was sent back to the Swedish Agency for Economic and Regional Growth for new processing.

At the time, Lars Klingström thought that the money would be paid out, but that has not happened.

- Then you have to get some feedback or get it right, get your support.

But after the administrative court's decision, it is quiet, he says.

Judgments that have become final

In at least 20 judgments, the Administrative Court has found that the Swedish Agency for Economic and Regional Growth does not comply with the law with regard to the comparison month.

Tillväxtverket has tried to pursue cases further, but was denied leave to appeal in the Court of Appeal.

They have now appealed to the Supreme Administrative Court.

However, several of the judgments have already gained legal force and at the end of March, more than 5,200 appeals are pending and are awaiting decision in the administrative court.

Should all of these wait six months or a year for this emergency aid?

- They must of course receive some kind of message from us, also during the process, says the Swedish Agency for Economic and Regional Growth's Director General Gunilla Nordlöf.

These are decided processes where you do not give these people the right even though they have been given the right in court?

- I can not answer more than I do, that we need to communicate with the companies that are living in uncertainty right now, what should happen in this case.
