The manager of a 65-year-old Haute-Loire laboratory was sentenced Tuesday to six months' imprisonment by the Puy-en-Velay criminal court.

During the first confinement, he had produced and sold non-compliant hydroalcoholic gel.

His sentence was accompanied by a definitive ban from managing a company, as well as a fine of 12,449 euros.

Aged 65, he was prosecuted for "deception on the nature of the goods" and "use of forgery in writing", detailed the prosecution.

The defendant's lawyer will appeal the judgment.

2,000 bottles sold

The case was triggered by an inspection by the Directorate General for Competition, Consumption and Fraud Control (DGCCRF) on this product from the Vector Energy laboratory in Saint-Maurice-de-Lignon.

His analysis had revealed an insufficient ethanol content (35%) to ensure a true anti-viral and anti-bacterial action, the minimum required being 60%.

Some 2,000 bottles had been sold at an additional price higher than that capped by the government.

Sentenced in another case to 6 months suspended

Manager of this laboratory specializing in natural products, the defendant was also sentenced Tuesday by a second judgment to six months suspended imprisonment for "usurpation of the title or the quality of pharmacist".

He appeared on direct summons from the National Council of the Order of Pharmacists for an advertisement in which he presented as a drug one of the productions of his company which has about fifteen employees.
