Düsseldorf (dpa / lnw) - As a severely disabled person with almost 40 years of service, he believed he could not be dismissed and was wrong: A 55-year-old chemical specialist could be dismissed without prior warning because of serious racist insults.

That was decided by the regional labor court in Düsseldorf and a judgment of the lower court confirmed (Az .: 5 Sa 231/20).

The worker had racially insulted colleagues of Turkish origin from outside companies on several occasions, the court said on Tuesday.

"My subjects" was one of the more harmless titles.

He had let his colleagues know that he had “wanted a gas chamber” for Christmas.

The skilled worker had turned out to be inviolable, as someone to whom one “could not do anything” because he had a handicapped ID and could not be terminated.

The balancing of interests had turned out to be to the detriment of the latter, despite its high social status and its rather poor chances on the labor market.

This also applies because the worker was not even irritated or verbally attacked before making his statements.

It was also not a one-off incident.

The court did not allow the appeal.
