The Valencia Court has confirmed the sentence to five years in prison for a crime of sexual abuse for Luis Eduardo RI, ex-husband of the vice president of the Consell Mónica Oltra and educator of minors in a center dependent on the Generalitat,

where he committed the crime about an internal girl

.

The Superior Court of Justice of the Valencian Community annulled the previous conviction for sexual abuse that the Valencia Court had imposed on the defendant and

ordered that the hearing be repeated and

that

two reports be taken into account

that questioned the credibility of the complainant girl.

In the repetition of the trial, the educator denied the abuses, but the Prosecutor's Office maintained his request for punishment and added the aggravating circumstance of prevaluation, which the Section 2 Hearing of Valencia

has taken into account in his conviction for the crime of continued sexual abuse of under 16 years of age.

The sentence, to which Efe has had access, considers it proven that the young woman, born on May 28, 2002, was protected by the Generalitat Valenciana since she was declared

in a situation of abandonment by administrative resolution

, and that in that center , where the inmate, the minor, worked as an educator "during certain periods of time in 2016 and early 2017, and as a consequence of bad behavior or that he did not comply with the regulations, he was frequently punished to sleep in a room separated".

"I went to the minor's room"

"On dates that have not been specified, but between two and 10 times, the inmate, who worked the night shift at that time, went to the room of the minor, who called him because he had difficulty falling asleep because of his fears

and he asked him to give him a massage, as he trusted him

, "added the proven facts.

The condemned man massaged the girl "in the area of the neck and the back and, once he thought she was asleep, he

took the girl's hand and masturbated with her

, pretending the least to sleep in the face of the shame caused by this situation" .

The Court convicted Oltra's ex-husband in December 2019, but the defense appealed to the Superior Court of Justice and asked him to acquit, or at least force him to repeat the trial given the defenselessness suffered

by the accused due to the "lack of diligence "of the Ministry of Equality and the prosecution.

"Lack of diligence"

That "lack of diligence," said the appeal, is the responsibility of the Ministry of Equality of which Mónica Oltra is the head, still married at the time of the events denounced with Luis R., but above all of the prosecution, since the former

He sent two exculpatory evidence to the second that was never put in the hands of the court that convicted

.

The Prosecutor's Office responded by reproaching the Department of Equality for silencing the girl's complaint for four months.

In the new sentence, the Court does not value these reports as exculpatory evidence, of which it goes so far as to say that

"the marked bias they suffer from beginning to end" draws the attention of the Court

and gives credibility to the young woman's statement in the first trial, because he finds "no reason to doubt her."

Despite the fact that the new exculpatory evidence has been studied in the new hearing,

the Court considers "in good conscience"

that they are not sufficient to vary the result of its first conviction.
