There is a new law from 2019 which states that an owner who runs a school or preschool must have knowledge and experience in the area.

It gives a municipality an increased opportunity to intervene against what is perceived as shortcomings.

Almost a year ago, the city of Helsingborg, with the support of the new law, said no to the two preschools that are run under the name Ruth, being allowed to continue their activities.

They are run by the same owner and are located in Drottninghög and Fredriksdal.

- It is especially fun that we got it right in the administrative court, considering that this was the first time that the law was tried in court, says Maria Winberg Nordström (L), chairman of the children and education committee.

Saw shortcomings in the business

According to Maria Winberg Nordström, the background to the municipality's decision was years of shortcomings.

- It was about lack of the skills required for a preschool.

Among other things, the needs of the children were not taken into account and those who needed special support did not receive it.

The owner of Ruth did not share that view and immediately appealed the city's decision.

But when the administrative court has now made its decision, it is the municipality that gets the right.

The owner's appeal is dismissed.

The two preschools' permits to conduct business are thus revoked.

- I am so happy, it feels as if it is the children who have won when the county court shares our opinion, says Maria Winberg Nordström (L).

The verdict can be appealed

The owner's legal representative, lawyer Jessica Stålhammar, tells SVT Nyheter that her client is considering appealing the verdict.

- It is deplorable that the court has taken so long to make a decision.

Then it is not a legally secure handling, she says.
