Aachen (dpa / lnw) - The Administrative Court of Aachen rates a mask requirement in the city center of Düren and a stay ban in the parks as "probably unlawful".
The relevant applicant is now exempt from following the rules.
In general, this does not yet apply because a preliminary decision had only been made in an urgent procedure, said a court spokesman on Friday.
At the beginning of February, the administrative court had already made a similar decision.
The city of Düren had ordered the wearing of everyday masks, which was sued.
The court upheld the lawsuit and stated that the requirement for the obligation to wear an everyday mask was that such a large number of people could be expected to meet that minimum distances could not be observed.
This is not the case in downtown Düren.
The city of Düren then revoked the general decree on February 10th.
On March 5, however, the district of Düren again ordered the wearing of a medical mask from 7:00 a.m. to 7:00 p.m. as well as a ban on staying in parks.
This was justified with high incidence values.
Against this, a lawsuit was filed, which the court upheld in an urgent procedure.

The court justified this with the fact that the district was not responsible for the question, but the city.
The mask requirement and the prohibition to stay are also likely to be illegal.
It is still not explained why there should not be enough space in the city center of Düren to keep the distances.
The prohibition to stay is also likely to prove unlawful.
It is not understandable against the background of the already existing distance requirement.
The district of Düren can lodge a complaint with the Higher Administrative Court in Münster against the decision.
