Münster (dpa / lnw) - In the dispute over the offshore wind farm “Butendiek” in the North Sea off Sylt, the nature conservation association (Nabu) is threatened with defeat before the higher administrative court in Münster.

At the hearing on Thursday, the court accused the Nabu of not having substantiated the environmental damage accused at any time.

In some cases, outdated data was used.

The Nabu rejected the allegations and asked the OVG to submit the issue to the European Court of Justice (ECJ).

The conservationists are suing the Federal Republic of Germany - represented by the Federal Agency for Nature Conservation (Bonn) and invoking the Environmental Damage Act.

They see two species of birds, the black-throated diver and the red-throated diver, 35 kilometers west of Sylt by the wind farm and demand that the damage be repaired.

Exactly how this could look is not part of the procedure and would have to be decided by the authorities after a judgment.

The VG Köln had dismissed the action in the lower instance (Az .: 21 A 49/17).

The OVG wants to announce a decision on Thursday.
