Karlsruhe (dpa) - As a subsidiary of Volkswagen, the car manufacturer Audi is not automatically liable in the diesel scandal.

The fact that the scandal engine EA189 developed by VW was also used by Audi in some models is not enough on its own, the Federal Court of Justice (BGH) in Karlsruhe ruled on Monday.

Specific evidence would be needed to show that those responsible at Audi at least knew about the illegal exhaust technology or that they themselves supported the strategic decision to use it.

Neither was found in the sample case decided.

The judges therefore overturned the lower court judgment of the Higher Regional Court (OLG) Naumburg.

The plaintiff now has the opportunity to clarify his allegations against Audi again before the OLG.

But that should be very difficult.

According to the company, there is a low four-digit number of such proceedings against Audi.

Most of the affected diesel owners have sued VW as the parent company for damages.
