Stuttgart (dpa / lsw) - Because she disregarded a travel warning, the state social court dismissed a 37-year-old's suit for compensation after a terrorist attack (Az .: L 6 VG 2770/20).

The woman from the Göppingen area was the victim of an attack by the Islamic State terror group on New Year's Eve 2016/2017 in a nightclub in the Turkish city of Istanbul, as a spokesman for the Regional Social Court in Stuttgart announced on Friday.

37 people died in the attack; the plaintiff suffered injuries to her knees and lower legs and a post-traumatic stress disorder.

The woman initially received a lump sum of 5,000 euros from federal funds for victims of terrorist offenses.

In November 2017, she also submitted an application to the state of Baden-Württemberg for benefits under the Victims Compensation Act (OEG).

The country rejected this on the grounds that she had disregarded the travel warnings issued by the Foreign Office at the time and thus put herself in danger.

The plaintiff dismissed this as “absurd and legally untenable ideas”, since people did not lock themselves at home on New Year's Eve and went to a festivity.

In its judgment, the regional social court confirmed the rejection of the benefits.

After the attempted coup in Turkey in 2016, warnings had been given to the whole country of a fundamental terrorist threat.

Especially in large metropolises, gatherings of people and places popular with foreigners should have been avoided.

Since the plaintiff disregarded this, she would have to bear the consequences “in the sense of personal responsibility”.

The verdict is not yet legally binding.
