Lüneburg (dpa / lni) - The current closure of dog schools in Lower Saxony is not legal in the opinion of the Higher Administrative Court in Lüneburg.

The 13th Senate temporarily suspended the regulation according to which dog training is generally prohibited according to the state's current Corona ordinance (Az .: 13 MN 67/21).

An operator of a dog school had resisted in his application not to be allowed to offer any puppy or young dog courses or behavioral therapy offers outdoors.

The Senate classified these outdoor courses as currently prohibited "face-to-face teaching in the field of extracurricular education" in accordance with the applicable Corona ordinance.

However, this prohibition violates the general principle of equal treatment with regard to a substantial part of the teaching of the dog schools, because even in the private sector a meeting of two dog owners from different households is allowed.

First aid training should also be possible so that students can even be admitted to driving tests (Ref .: 13 MN 78/21).

The prohibition leads to an interference with the provider's freedom of occupation.
