Münster (dpa / lnw) - According to a court decision, a student from the Fernuni Hagen in Bonn has to live with the fact that video and sound surveillance is saved during his exam on Monday (March 8th).

The higher administrative court for the state of North Rhine-Westphalia decided in an urgent procedure against the corona examination regulations of the Fernuni, as the court announced on Thursday.

The decision is not contestable (Az: 14 B 278 / 21.NE).

In the corona pandemic, the Fernuni Hagen offers an exam at home as an alternative to the attendance exam that is currently not possible.

The supervisor monitors the test item via video and audio connections as well as the display of the screen.

If there are no abnormalities, the material will be deleted after the examination.

The plaintiff did not object to the video surveillance, but against the recording because he sees it as a violation of the General Data Protection Regulation.

The court rejected the application because the legality could not be clarified in the urgent procedure.

However, the court sees the university's duty to ensure equal opportunities in examinations and to prevent deception.

The recording for the preservation of evidence is therefore suitable and necessary.
