The Moscow City Court overturned the verdict of the Cheremushkinsky District Court in the high-profile case of the hematologist Elena Misyurina and dismissed her case.

She was accused of providing services that did not meet the requirements that resulted in the death of the patient (part 2 of article 238 of the Criminal Code of the Russian Federation).

After the court's decision, Misyurina shared her feelings and said that she had believed in her innocence all these years.

- How long did this case last?

- Exactly 7 years, 1 month and 1 day.

- Did you suppose that everything would end so favorably?

- I always hoped for it and all this time with my lawyers I tried to prove my innocence.

If I didn’t believe it, I wouldn’t fight for justice and truth.

In the end, everything worked out.

- How do you feel after it's over?

- I'm happy.

- Do you think the prosecution will appeal the verdict?

- I do not know.

I don't even want to think about it.

I thought about all this for seven years.

Everything that could have happened has happened.

Therefore, I am no longer afraid of anything.

- What have you learned from this whole history that has been dragging on for many years?

- Of course, I have matured.

I saw that there were many good people around me, real and true friends.

During this time, betrayals were also tested by this difficult situation.

We have experienced it all.

They have become smarter, wiser.

Professionally developed with my team - developed the hematological service and introduced new methods of treatment.

There was tremendous support from the professional community, acquaintances and strangers.

- Did you expect so many people to stand up for you?

- When you find yourself in such a situation, then you find yourself with this misfortune one on one.

Honestly, I didn't expect it.

But, apparently, the absurdity of the charges brought against the professional community caused a public outcry, and I am sincerely grateful to everyone who stood up for me, supported and believed.

This was unexpected.

Of course, I was not available at that moment for communication and communication, but I sincerely thank everyone.

I'm happy, it's very touching and important.

It gave me strength.

- Were there any restrictions due to the case?

If so, would you like to do something now that was impossible?

- Of all the time, I was almost five years under recognizance not to leave.

This did not impose any restrictions on my professional activity.

In order to leave, it was necessary to notify the investigating authorities.

If they allowed, I left.

Therefore, there were no prohibitions.

But purely emotionally, it was all unpleasant.

- Today, when you went to court, did you expect that this is how it will be?

- When we went to court, every time we hoped for the triumph of justice.

Without this faith, my defenders and I would not have been able to make it to this day.

- According to the law, you now have the right to rehabilitation and compensation for illegal criminal prosecution.

Are you planning any steps in this direction?

- I don’t think about it at all.

I'm just happy that it's over.

As RT previously said, on July 25, 2013, a patient with diabetes insipidus, myelofibrosis and prostate cancer came to the clinic where Misyurina worked.

The doctor performed trepanobiopsy (collection of bone marrow material in the pelvic region), after which the patient left the clinic on his own. 

On the evening of the same day, he called an ambulance and was admitted to the Medsi clinic with complaints of abdominal pain.

A few days later, the man died in the intensive care unit. 

A year and a half after the patient's death, in 2015, a criminal case was initiated under Part 1 of Art.

109 of the Criminal Code of the Russian Federation (causing death by negligence).

A year later, the article was re-qualified for a heavier one - clause "c", part 2 of Art.

238 of the Criminal Code of the Russian Federation (provision of services that do not meet safety requirements and resulted in the death of a patient).

According to the prosecution, the doctor allegedly violated the "methodology, tactics and technique" of the procedure, as a result of which the patient had perforating damage to the blood vessels, which led to death.

Misyurina herself claimed that she had carried out the procedure correctly, since in case of violations, the patient would have a severe pain syndrome. 

On January 22, 2018, the Cheremushkinsky District Court of Moscow sentenced the doctor to two years in a general regime colony.

The case itself and such a harsh sentence caused a great resonance.

Moscow Mayor Sergei Sobyanin, at that time the head of the HRC Mikhail Fedotov, Deputy Prime Minister Olga Golodets, State Duma deputy Vladimir Gutenev reacted to him - all of them, one way or another, sided with Misyurina, expressing their support.

The verdict was appealed, and on February 5, the Moscow City Court, at the request of Misyurina's defense, changed her preventive measure to a written undertaking not to leave the place.

In addition, on April 16, 2018, the Moscow City Court noted the decision of the Cheryomushkinsky court and returned the case to the prosecutor's office. 

On December 16, 2020, the Second Cassation Court of General Jurisdiction overturned the decision of April 16, 2018 and decided to send Misyurina's case for a new consideration to the appellate instance, that is, to the Moscow City Court, where the meeting was held on March 4, at which the case was dropped.
