  From May to July 2020, the Standing Committee of the National People’s Congress organized and carried out the “Decision of the Standing Committee of the National People’s Congress on the Total Banning of Illegal Wildlife Trade, Elimination of the Bad Habits of Wild Animals, and Effective Protection of the People’s Life, Health and Safety” and the “Chinese Law Enforcement Inspection of the Wildlife Protection Law of the People's Republic of China (hereinafter referred to as "one decision, one law" law enforcement inspection).

  The law enforcement inspection report pointed out that during the implementation of the “one decision, one law”, the problem of industrial conversion and transformation of edible artificial breeding wild animals is more prominent, the relevant list needs to be adjusted and perfected, the law enforcement supervision mechanism has loopholes, habitat protection management needs to be strengthened, and wildlife Problems occur from time to time, and relevant legal systems need to be revised and improved.

  How are these problems found in law enforcement inspections resolved?

On February 27, the State Council’s report on the study and handling of the “one decision, one law” enforcement inspection report and review opinions was submitted to the 26th meeting of the 13th National People’s Congress for deliberation.

The report pointed out that under the strong impetus of the "one decision, one law" law enforcement inspection, significant progress has been made in implementing fasting of wild animals and strengthening wildlife protection.

In accordance with law enforcement inspection reports and deliberation opinions, various regions and departments have adopted a series of powerful measures to strengthen and improve work, and have achieved positive results.

  Improve the supporting system for wildlife protection

  "According to the unified deployment of the Standing Committee of the National People's Congress, the relevant departments of the State Council organized and carried out the clean-up work of regulations, rules and normative documents in the field of wildlife protection, carefully sorted out and actively improved the supporting system for wildlife protection." said Guan Zhiou, director of the State Forestry and Grassland Administration.

  It is worth mentioning that, with the approval of the State Council, the Bureau of Forestry and Grass and the Ministry of Agriculture and Rural Affairs completed the adjustment of the "National Key Protected Wildlife List", which is the first comprehensive adjustment in more than 30 years.

  According to reports, the Forestry and Grass Bureau organized experts to draft the preliminary adjustment plan for the "List of Terrestrial Wild Animals with Important Ecological, Scientific, and Social Values" and the assessment and identification procedures for important terrestrial wildlife habitats, and strive to release the first batch of terrestrial wild animals as soon as possible. List of important animal habitats.

  In addition, the report shows that the administrative licensing of wild animals and their products, special label management, and value evaluation systems have been further improved.

The Bureau of Forestry and Grass drafted the management measures and scope of special marks for wild animals and their products. The Supreme People's Court, the Supreme People's Procuratorate, the Ministry of Public Security, and the Ministry of Justice made corresponding provisions on the evaluation standards and accounting methods of the wild animals and their products involved.

  Carry out special law enforcement operations

  The report pointed out that relevant departments organized comprehensive rectification and enforcement actions.

  The General Office of the State Council took the lead in formulating an implementation plan for strengthening legislation and law enforcement in the field of wildlife protection, and after reporting to the Party Central Committee and the State Council for approval, the relevant parties were deployed to implement it, which vigorously advanced the work.

The Central Political and Legal Committee fully supports the crackdown on illegal wildlife crimes, combined with the special fight against crimes and evils, to dig deep into the criminal forces and their "protective umbrellas" behind criminal crimes that damage wildlife resources.

The Forestry and Grass Bureau organized 26 departments and units to convene the third meeting of the Inter-Ministerial Joint Conference on Combating Illegal Trade in Wild Fauna and Flora to improve law enforcement mechanisms and deploy law enforcement actions.

The Supreme People’s Court, the Supreme People’s Procuratorate, the Ministry of Public Security, and the Ministry of Justice have studied and formulated guidelines for the punishment of illegal wildlife trade crimes in accordance with the law. The Supreme People’s Procuratorate promptly released typical cases of wildlife protection public interest litigation and increased the intensity of case handling.

  The figures show that the Ministry of Public Security, the Ministry of Agriculture and Rural Affairs, the General Administration of Customs, the General Administration of Market Supervision, the Forestry and Grass Administration and other departments have carried out special enforcement actions against illegal wildlife trade. Approximately 2.9 million law enforcement personnel and approximately 350,000 vehicles have been dispatched to handle wild animals. There were 3,792 animal violations, 6,207 poaching tools were confiscated, about 120,000 wild animals (articles, heads), and about 5,063 kilograms of wild animal products were confiscated, effectively curbing the momentum of illegal crimes.

  Continue to do a good job in the transformation and assistance work

  At the same time, the report pointed out that there are still some problems that need to be resolved.

For example, there are still some farmers who have not determined the direction of transformation and development, and a small number of farmers need to continue to increase assistance due to large losses of breeding facilities and heavy debts.

In another example, the weak supervision of grass-roots wildlife protection law enforcement and insufficient professional capabilities are still the main factors restricting the effectiveness of law enforcement.

At the same time, the division of responsibilities for law enforcement and supervision of relevant departments and units needs to be further implemented, and the multi-link linkage mechanism needs to be further improved, and so on.

  Regarding this, Guan Zhiou said that in the next step, we will continue to do a good job of helping farmers to switch to production, comprehensively implement measures to prevent and control wild animal hazards such as wild boars, continue to strengthen law enforcement and supervision, continue to promote the improvement of wildlife protection laws and regulations and supporting systems, and strengthen Infrastructure for wildlife protection.
