  In recent years, with the improvement of living standards and the deepening of the construction of beautiful villages, some beautiful villages have attracted more and more attention, and more and more people in the city hope to live or vacation in the countryside.

A small number of individuals or developers aim at "business opportunities" and make changes in various ways to build "small property houses" or private villas and clubs in rural areas.

  In fact, the statement made by the Ministry of Agriculture and Rural Affairs this time is not the first time that it has called a halt to the “cooking idea” of rural homesteads.

Prior to this, the National Development and Reform Commission, the former Ministry of Land and Resources (now the Ministry of Natural Resources) and other ministries and commissions have repeatedly issued documents or stated that urban residents are strictly prohibited from buying land and building houses in rural areas and using rural homesteads to build villas and clubs.

  National ministries and commissions frequently "proclaim", but similar phenomena are still banned. Although some people yearn for rural scenery and attachment to homesickness, the more important reason lies in the fact that rural construction land has not yet been established in a unified urban and rural construction land market. The low land price and low construction cost of housing can easily induce the impulse for profit.

  The homestead is an important land property for farmers, and it is also where farmers live.

In 2018, the “No. 1 Document of the Central Committee” proposed to explore a new round of reform of the “three powers” ​​of the ownership, qualification rights, and use rights of rural homesteads within the framework of the rule of law; in 2020, relevant central ministries and commissions in 104 counties across the country The urban area and 3 prefecture-level cities have launched a new round of pilot reforms of the rural homestead system, the core of which is to explore the form of realization of the "three rights separation" of homesteads.

  These reform measures indicate that problems such as the entry of rural collective construction land into the market, the transfer of farmers’ homestead use rights, mortgages, voluntary and paid withdrawal, and paid use are all being explored and resolved.

The reason for steadily advancing the reform of the rural homestead system is, in the final analysis, to protect the legitimate rights and interests of farmers.

  To strictly prevent urban residents from going to the countryside to use rural homesteads to build villa complexes and private halls, first of all, in accordance with the requirements of the central government, maintain sufficient historical patience, and steadily advance rural land system reform.

Stick to the three bottom lines of keeping the nature of public ownership of land unchanged, keeping the red line of arable land from breaking through, and keeping peasants' interests intact, so as to ensure that the reform is always moving in the right direction.

  To stop the unhealthy trend of urbanites going to the countryside to build villas and private clubs, we should also step up crackdowns on violations of laws and regulations.

Facts have shown that in the face of high returns, some people often take risks by targeting rural homesteads and other "Tang Seng meat". It is necessary to supervise and enforce the law and strictly investigate and deal with such behaviors.

Prior to this, the establishment of luxury clubs, leisure resort facilities and even villas in some illegal large-scale sheds was severely investigated and cleaned up, which played a deterrent effect.

Faced with the wave after wave of "going to the countryside" to buy houses and build villas, many parties do not understand the nature of collective ownership of rural homesteads, and are unaware of the "Land Management Law" and other laws and regulations regarding the prohibition of illegal sales of rural homesteads, etc. The relevant regulations are even poorly understood. This aspect increases the illegal risk of urban residents buying land and building houses in the countryside, and also causes some unnecessary losses to rural investors who do not understand the law.
