  • The Marseille criminal court sentenced eleven supporters to six months suspended prison sentence, one to three months and two were released.

  • They were on trial for the invasion and damage to the Commandery on January 30.

  • Defense lawyers regretted a "single judgment" for the majority of these supporters.

A marathon trial.

The Marseille Criminal Court sentenced eleven Olympique de Marseille supporters to six months suspended prison sentence, another to three months in prison, and released two others after the incidents at the Commanderie on January 30.

They were sentenced for participation in a group for the preparation of willful violence on people or damage to property, possession of smoke, or narcotics, after nearly twelve hours of debates.

Among the eleven people sentenced to six months in prison, the cases vary however.

If some of them admitted to having returned to the Commandery, all of them denied having committed any damage.

Except Romain, 19, who admitted to having knocked on a Bac car.

But they were all sentenced to the same sentence.

Faisal, 23, is the only one who has been sentenced to prison, due to a previous suspended sentence.

His sentence should be adjusted by the judge of freedoms.

As for Dorian, 22, and Thomas, 33, they were acquitted.

Dorian, however, served ten days in pre-trial detention after being arrested with an opinel which he used for convivial moments "on construction sites, to eat sausage or prime rib".

Thomas, himself, explained to be "arrived and direct it left in ball so I cut myself, and bam there I am being challenged".

"Yes that's the passion madame"

Apart from participating in a gathering, the courts had no material element of the guilt of the supporters.

Except for Romain, who acknowledged his participation.

The president of the tribunal, Paule Colombani, questioned them about a possible premeditation in the action carried out at the Commanderie on January 30.

"You drive for 7h30 to come and make a peaceful demonstration in front of the gates," Paule Colombani asked Mohamed, who came from Montceau-les-Mines.

"Yes that's the passion madame", he retorted.

After his ten days in pre-trial detention, Julien, 27, says he is "followed by a psychologist".

(…) “I lost ten kilos in ten days.

Never, never, I would have come if I had known that it would happen like that ”, explains this baker, who takes care of the two children of his concubine, in addition to extras as a caterer.

Small Angora cats

The smoke bombs also animated the debates at length.

Almost 300 were launched that day.

And what about the Commando Ultra?

“Commando”, André Ribes insisted, while the court has repeatedly ticked off this name.

"Maybe you wanted them called the little Angora cats?"

“, Joked Alain Baduel, historical lawyer of the group of supporters.

And then tried to do “a little sociology” around ultra culture: “Being a supporter is not just going to the game and applauding in front of great actions.

It is participating by putting pressure on the opponent, through shouts, chants, whistles, but also by putting pressure on your own team.

This is called the 12th man, ”he recalled.

As for the smoke?

"Yes they have a little cute sin, it's smoke bombs.

Who is the symbol of their passion because it is consumed and because it shines.

It is not an object of degradation, ”he smiled.

The anger against Jacques-Henri Eyraud, the reason for the demonstration, was hardly ever mentioned by the court.

"Unique crowd"

At the end of the hearing, the defendants' lawyers regretted through the voice of Master Nicolas Besset that "the court considered that out of a crowd of 300 people there was a single crowd, that there could not be several different aspirations so each was sentenced to the same sentence indiscriminately.

Without trying to understand those who committed actions, those who left, those who remained passive.

It is a decision that I do not accept even if the convictions are measured ”.

A new hearing is scheduled for June 25 regarding any damages to be paid to OM, while the club has requested 87,000 euros for damage and 140,000 euros for moral damage.
