Berlin / Potsdam (dpa / bb) - The Brandenburg drug company Lunapharm is still not allowed to manufacture or trade drugs.

The company was also defeated in the second instance against the drug regulatory authorities.

The appeal against a decision by the Potsdam Administrative Court had been rejected, the Higher Administrative Court announced on Friday (OVG 5 S 17/20 of February 18).

The decision is final.

At the beginning of 2019, the State Office for Occupational Safety, Consumer Protection and Health banned Lunapharm from manufacturing and trading drugs.

The managing director did not have the required reliability, it said.

For several years, medicines had been obtained from a Greek pharmacy that was not authorized to wholesale.

In addition, a drug for the treatment of breast cancer was traded in Italian packaging, although a legal purchase of this drug from Italy was not possible.

When purchasing medicines from a Cypriot company, she concealed distribution channels.

The Higher Administrative Court saw the allegations confirmed in a summary examination, it said.

It cannot be ruled out that the activities will continue.

The protection of the health of the population outweighs the private economic interest.

The scandal surrounding the illegal trade in cancer drugs became known in July 2018 according to a report by the ARD magazine “Kontraste”.

The then State Health Minister Diana Golze (left) had to resign in August 2018 because the State Health Office allegedly did not intervene despite early evidence of illegal trade.
