Detmold (dpa / lnw) - For the use of pepper spray against a dog and the dog owner, a 64 year old woman has to pay a fine of 4800 euros.

Your appeal against a judgment of the Blomberg District Court was unsuccessful.

The Detmold district court confirmed on Tuesday the payment of 120 daily rates of 40 euros each for dangerous bodily harm and violation of the Animal Welfare Act.

As the motive for the attack in Schieder-Schwalenberg in the Lippe district in April 2019, the retired pharmacist had given a panic of dogs.

Even in the appeal before the Detmold regional court, the jogger stuck to the fact that she felt attacked by the dog that was not on a leash and therefore used the spray.

She denied having sprayed the dog owner, a 45-year-old police officer, too.

The injured party, in turn, stated as a witness in court that the dog, a Golden Retriever trained as a visiting dog for old people's homes, had ignored the jogger at all.

Rather, the woman ran to the dog on her own initiative and used the pepper spray, as well as against him when he loudly asked her to leave the dog alone.

Both dog and owner had suffered pain from the pepper spray, the criminal chamber ruled.

"You have to learn to deal with your fear of dogs differently than to jog with the pepper spray at the ready," emphasized the prosecutor.
