Sunday, the Minister of Justice, Éric Dupond-Moretti, said he was in favor of a threshold of non-consent set at 18 years in the event of incest.

While a text aimed at combating sex crimes will soon pass through the Assembly, associations seem to support this proposal which would prevent the invocation of "consenting incest".

On Thursday, the National Assembly is due to study a text aimed at strengthening the fight against sexual crimes committed against minors under 15 years old.

This Sunday, the Minister of Justice, Éric Dupond-Moretti, said he was in favor of no longer considering the consent of victims before 18 years of age in the event of incest.

This threshold could be set at 15 years for other cases of sex crimes.

This measure was demanded by associations such as Facing incest: "For us, this is a real step forward," enthuses its vice-president, Patrick Loiseleur, at the microphone of Europe 1.

A "very clear" signal sent to adults

"It sends a very clear signal to adults," he continues.

"Whatever the behavior of the child, we are not going to question him to ask if he was consenting or not."

In fact, such a measure would prevent a person accused of sexual assault or rape of a minor in his family from invoking "consenting incest".

"It was argued again recently before the French courts for children over 15 years in particular", laments Patrick Loiseleur.

The latter nonetheless welcomes the prospect of seeing the specificity of incest recognized in the Criminal Code.

"If we really want to protect children, we will have to mobilize well beyond the legal response, to really do prevention and improve the care of victims."
