This was established by the Court of Justice of the EU, which proved Junqueras right, sentenced by Spanish justice to 13 years in prison and expulsion from the public office for the organization of the referendum on the independence of Catalonia.



Junqueras is currently in prison in Spain, sentenced for sedition after the 2017 referendum. According to the Luxembourg judges, a person elected to the European Parliament acquires the status of MEP at the time of the official declaration of the results and has benefited from that moment on. related immunities.

At the time of his election to the European Parliament, Junqueras was in preventive detention.    



The Junqueras ruling should also have repercussions on two other Catalan independence leaders, the former president Carles Puigdemont and Toni Comin, elected to the last Europeans, but who were unable to take office, because they were unable to go to Madrid to swear Spanish constitution as required by national legislation.

The Spanish authorities did not send the proclamation of the election of the three Catalans to the European Parliament and consequently the European Parliament refused to let them take office.
