February 13, 2021 The administrative court of Puglia, section of Lecce, rejected the appeal presented by ArcelorMittal (AM) against the order signed by the mayor of Taranto, Rinaldo Melucci on February 27 last year, which prepared the closure of the hot area if, in the 30 days following the provision, the polluting sources had not been identified and removed.



The judges, the ruling reads, believe "that the emission phenomena indicated in the contested order were caused by technical malfunction, faulty monitoring and emergency response activities, as well as criticalities in risk management and in the system of procurement procedures. and negligent preparation of warehouse stocks "and deem" all the reasons given in support of the appeals "presented by AM to be unfounded and provide that the deadline assigned to the extent of 60 days for the completion of the shutdown operations of the area to be respected hot, in the terms and in the ways exactly indicated in the contested trade union ordinance ".



In the order signed by Melucci, the TAR does not see "any violation of the principle of proportionality which is, on the contrary, violated to the detriment of the health and right to life of the citizens of Taranto, who have paid a contribution in terms of health and human lives that it certainly goes well beyond those "reasonable limits", compliance with which alone can allow, according to our Constitution, the continuation of this industrial activity ".



The Tar condemns ArcelorMittal, Ilva in extraordinary administration and the Ministry of the Environment to reimburse expenses to the Municipality of Taranto, Arpa Puglia and Codacons.
