The future of the trial of
box B
of the PP is uncertain.
The oral hearing had already been postponed until February 16 to await the recovery of the former manager of the PP
Cristóbal Páez
, infected with coronavirus.
Last night his situation worsened and he was taken by ambulance to the Clinical Hospital of Madrid, where he was diagnosed with pneumonia.
This Thursday he was scheduled to be transferred to the Isabel Zendal pandemic hospital.
Páez's lawyer,
Gonzalo Martínez-Fresneda
, has communicated this Thursday morning the situation to the Second Section of the National Court, which next Tuesday will resolve various preliminary questions raised by the parties and will decide on the continuity of the oral hearing .
Páez, manager of the PP when Luis Bárcenas acceded to the Treasury, was able to follow the two initial sessions of the trial by videoconference, but asked to be present in the courtroom to give a statement and hear that of four other defendants.
All parties supported him and the court agreed, stating that the suspension respected "his right to a defense and to appear in court."
The statement before Pedraz suspended
Páez resides in Argentina and had moved to Spain for the trial.
When he arrived, on February 4, he was tested for coronavirus after having had close contact with a positive one.
The next day he had a fever, which has not stopped rising until he was admitted.
If he had recovered quickly, the trial should resume with the statement of the main defendant, Luis Bárcenas.
But the former treasurer will not testify on Tuesday in the trial of
box B
, nor on Monday before the judge investigating the donations from businessmen with which the opaque accounting of the party was swollen.
Also this hearing has been postponed at the
request of the Barcenas himself, who preferred to
have more time to prepare his statement in the trial of the
case B
.
Judge
Santiago Pedraz
has accepted the request, according to legal sources.
In this case, the postponement is at least until mid-April, given that Pedraz is currently in charge of two High Court courts.
In the same postponement resolution, the judge asks that, in the meantime, Bárcenas "provide, where appropriate, the evidence base (documentary ...) on which the statements he makes can be supported," in reference to what the former treasurer stated in his recent letter to Anticorrupción.
The 'Operation Kitchen'
Among other things, that the former Prime Minister Mariano Rajoy was aware of
box B
, which destroyed the documentary trail without knowing that he kept a copy and that the donations from the businessmen were seeking to obtain specific public awards.
On February 15, Bárcenas also had to testify as injured in the case for the "Kitchen operation" before another judge of the National Court,
Manuel García Castellón
.
The lawyer representing Bárcenas in this case has reported that she is also infected with coronavirus, which can also disrupt the schedule for that diligence.
